Recruit Modesette Case Study
On 06/15/17 Deputy Blocker notified me by telephone that Recruit Modesette was out of control and threatening to harm himself. Deputy Blocker said Recruit Modesette pulled in behind a vehicle at an intersection, so close to the vehicle that he could not see the rear bumper of the vehicle in front of him. Deputy Blocker said he has had several instances where he has had to correct Recruit Modesette’s driving and Deputy Blocker said these instances have been documented in the Recruit 360 FTO program.

Deputy Blocker said he began to counsel Recruit Modesette about officer safety and not leaving an escape route when Recruit Modesette went hysterical. Deputy Blocker said Recruit Modesette began banging on the steering wheel and screaming he felt like he wanted to “blow his fucking brains out” and then said he wanted to quit. Deputy Blocker said Recruit Modesette repeated these statements more than once.

The legal issues in this case involved the treatments of Petty, a former Police Officer who left the Metro Police Department for active duty with the United States Army. Upon his request to be reinstated, Petty was not placed in his original position as a patrol sergeant or a similar position based on the completion of the return-to-work form n which he did not disclose all the facts regarding his discharge status. The police department return-to-work process is a policy that is required for all officers to complete if they were away for an extended period of time no matter what the reason for their separation. One of the questions on the personal history questionnaire Plaintiff filled out during the return-to-work process asked: “During your absence were you arrested, charged, detained, or a suspect in any criminal action or military disciplinary action for any reason or do you have any action pending? If yes, explain in detail (use back if necessary).” Petty answered “Yes.” He also attached a narrative explanation of his response in which he admitted facing military charges in Kuwait. The narrative description did not disclose: (1) that Petty was accused of giving alcohol to an enlisted soldier; and (2) that Petty was accused of manufacturing alcohol. Since Petty did not mention facing military charges for manufacturing alcohol while in Kuwait, he was assigned to desk work. (Walsh, 2010, p.348) Under the Uniformed Services Employment and Reemployment Rights Act (USERRA), as stated in chapter 11 page 346, employers are prohibited from discriminating against member who serves in uniformed military services. It also guarantees the return of a veteran right of reemployment after military service is required to return to their original position or a similar position.…

During the monthly NCOICs meeting, all supervisors, including the First Sergeant and myself, commented about the unstable conduct presented by SFC Orriola. Each supervisor presented recent situations where SFC Orriola showed exaggerated attitude, nervousness, and some kind of restlessness. Leaders concurred that they were stunned with the Sergeant First Class reactions and at the same time worried. We all agreed that SFC Orriola’s disturbing reaction and emotional behavior could affect his performance and worrisome since SFC Orriola was one of the most experienced senior Leaders working with applicants, recruits, family members and civilians. One of the most difficult decisions a law enforcement officer may have to make is the decision to use deadly force. Our society places a high value on human life and no matter the circumstance; the taking of a human life is frowned upon. Today’s law enforcement officer has been placed under a microscope and every action, word, comment and expression is scrutinized by the public and the media. When the situation dictates the taking of a human life by a law enforcement officer in the line of duty even more emphasis and examination falls upon the officer and the department. Fortunately, because of advancements in technology and training, today’s officer is better trained and afforded a variety of less lethal options when confronted with a use of deadly force situation.
