Do you consider the criminal justice system fair to all: minorities, genders, socioeconomic classes, and people of different sexual orientations? Explain either why you do or why you do not.

The Criminal Justice system was made to be fair to all, but throughout the years the Criminal Justice System has changed in my eyes. I do not agree that the Criminal Justice System is now fair to all minorities; gender and socioeconomic class. I feel it unfairly targets people of color, as well as people who do not come from much wealth, it is also inconsiderate to gender as well as men who are sentenced to longer prison terms than women for the same crimes. No I do not think the criminal justice system is fair to all minorities, although it is not directly prejudice against people of color or people who are poorer. However the law enforcement agency discriminate against people of color that is known as minorities who are more likely to commit more crimes. The criminal justice system is based on our history and works for all people. Although it appears to not punish certain people in certain cases. The law often seems unfair and biased to some. I feel as though the law looks at a person differently if they have a higher education other than a high school diploma verses someone who has dropped out of high school. If a person who from comes a background of wealth can and will most likely to buy their way out of a situation, meaning they can afford a really good attorney to help build and fight their case that could prevent them from going to jail. Where on the other hand a person who comes from a poor background would have to settle with a district attorney that is appointed to them who can possibly care less what happen to them and just offer what the D.A wants to give them. It is no coincidence that an overwhelming majority of the nation’s inmate population comes from lower socioeconomic status communities. Police

    Many defendants who have cases that are correspondingly situated are tried unequally. In my opinion, there are many outside factors that are discussed far too excessively when trying an individual. Unjust resolutions of cases are produced because crime, prior history and race of the defendant are sometimes taken into more consideration rather than the exact context of each specific case being tried. For example, there was a case where four teenage boys committed the same crime but received drastically different punishments. Four boys all around the same age ransacked a home in Tampa Florida. After a few weeks, all boys were arrested. The boys faced the exact same charges: burglary and theft. Two out of the four boys were able to escape from harsh punishment. They were charged as juveniles and put on probation. Out of the four boys, two were Hispanic; the Hispanic boys are serving four-year sentences. All the boys in the cases were minors. This ruling of this case is unjust. This case proves that outside factors that are not involved in a case are playing roles in the sentencing.     Today’s incarcerated youth is made up by two-fifths African-American and one fifth Hispanic. Today’s minority youth are facing stricter punishment than their white counterparts, resulting in a larger number of minority youth jailed. The article, “Preliminary Report on Race and Washington’s Criminal Justice System” (Anonymous, 2012), states that “African-Americans are over represented in the prison population because they commit a disproportionate number of crimes”. This seems to be an unfair judgment due to the fact that minorities are more than two times more likely to be searched or stopped for any kind of criminal activity based on the color of their skin. For example, “among felony drug offenders, black defendants were 62% more likely to be sentenced to prison than similarly situated white defendants.” (Anonymous, 2012) Also once convicted, African-Americans were 21% more likely to receive harsher punishment compared to white offenders with a sentence that is 10% longer than white offenders that committed similar offences.
