M2 Describe legislations and regulations, working strategies and procedures used in health and social care to reduce the risk of two types of abuse
Scenario one
I am going to use an elderly lady, called Arlene (aged 91) who lives in a residential care home who is being neglected by the care providers in the setting.
Care standards act 2000 is a legislation put in place in health and social care settings to ensure that all the standards are met at all times and something is done about it if they are not, these are assessed regularly, therefore Arlene should not be being neglected as this is a poor standard of care so is not meeting the requirements of this law.
Care Quality Commission (CQC) do regular checks on a health and social care setting to ensure that they are meeting the roles and responsibilities they are required to meet, they do this to ensure that all service users in a setting are being cared for and not being abused in any way, with them doing checks the staff should always be protecting the service users and ensuring that they are being cared for to their best ability and not being mistreated, neglected or abused.
Members of staff, when they begin work, receive staff training they also have updates to this training when any changes are made. When they go to this training they will be made aware of how some service users in a setting are highly dependable on the staff to move around, get changed, to be able to eat (if they need to be fed) they will be told how to do this and how not to allow the service user to be neglected, like Arlene is, or forgotten about and any time whilst they are in charge of their level of care received.
Procedures need to be in place and fulfilled to allow for the service users to be safeguarded against and for the level of abuse to be reduced to be as low as possible.
When Arlene’s family notice that she is not being cared for to the standard which is stated that she will be they decided to record how she was when they went to visit on a daily basis and how her appearance and hygiene where they did this by keeping a diary. When they attended the care home they noticed that Arlene was being left out all the time (when activities where taking place, when drinks where being given out and one day they didn’t even feed her as they were short staffed etc).
They then noticed it was going on for some time so they wanted to do something about it as it wasn’t fair on Arlene. So they followed the complaint procedure, to put the complaint in about the member of staff in the setting and how they were treating the service users, especially Arlene. This was done to try to improve the service received and to improve the quality of life of the service users.
Scenario two
Physical abuse, Colin is a 25 year old male who lives on his own; he suffers with Down syndrome and server learning difficulties. He has carers who come and assist him with his daily needs three times a day, this includes helping him to get changed, showered, ironing and washing, they also cook his meals for him. One of his care workers who come every night time to cook his tea and assist him with getting ready for bed are physically abusing him, this occurs on a daily basis.
Colin does not speak out about this abuse and keeps it to himself as the care worker had threatened him so he is afraid to tell anyone. As he suffers with Down syndrome he doesn’t realise how bad this is, that it shouldn’t be happening and that it can be stopped.
Under the safeguarding vulnerable groups act 2006 he should not be treated in this way as it is breaking this law as this law states that no one who is a threat or harm towards anyone should be allowed to work I a health and social care setting as it is not safeguarding the service user.
The human rights act 1998 states that everyone is entitled to these rights and no one should have them taken away from them, despite Colin suffering with Down syndrome and learning difficulties he is still entitled to these right and therefore shouldn’t be being abused in his own home by the care worker who is meant to be supporting and helping him with everyday tasks. This in place as it should be stating to everyone that no one should be mistreated or abused in any setting no matter who they are.
When this member of staff was employed they would have undergone the recruiting staff section where they would have had a CRB check done this shows that the member of staff has never been caught abusing or she hasn’t done it before so this displays even more why Colin needs to speak out and make people aware of what is going on so that something can be done an it can be put on her records.
To help to prevent him from being stuck in his home all day every day his social worker and care workers will have regular meetings with which they will ensure multi agency working as they will share and discuss various plans and ideas suitable for Colin and have people from different settings and places come in to get the best outcome.
When a care worker notices the bruising which Colin is suffering with they will need to use the ARDARM procedure.
They will need to ALERT; this means they will need to inform Colin’s social worker and the head of the care company, they will also need to help and support Colin to make him feel safe and reassure him it will no longer happen.
They will then need to do a REFERRAL; this will include Colin telling other members of authority about what has been happening, his information given may also be referred to the police and high authorities to allow the most effective outcome to be achieved.
Next DECISION MAKING will be made to assess the situation and work out what is best to happen next this will also be done to make all of Colin’s care workers aware of what has gone on and what they need to do to support and help Colin out, this will also need Colin input to let him have his say of what he wants and what help he feels he will benefit from.
Then an ASSESSMENT will need to be undertaken to assess the situation to ensure that his abuse has stopped and that he is gaining his self- esteem again and it is not affecting his everyday life as a long term effect.
This will be REVIEWED regularly by his social worker and care workers to ensure he is not becoming affected in any way and to ensure he is now feeling safe and protected in his own home setting.
Final his case will be MONITORED to make sure that everything is how it should be and no one else who cares for him is doing the same to him. This is done to ensure that the complaint is overcome and that any improvements possible are made.
