On the SSA 3368, the claimant lists five jobs. Work as a cashier 2/2008-10/16, as a home health aide 2007-2008 and as a resident aid 2/2005-8/2007 is described on the SSA 3369. Work as an aide 2002-2002 and work, as a cashier at a convenience store 2001-2004 is not listed on the SSA 3369 or elsewhere in the file. A detailed description of this work is required. It is unclear if work done an aid in 2002 is relevant. The earnings appear to be SGA, however there are no dates worked

There is no description of what her supervisory duties entailed. For example: Did she assign duties to the aides she supervised? Did she observe the care that the aides provided and ensure treatment was administered in accordance with instructions? Did she train the aides? Did she make schedules, reprimand employees or train new workers? Per DI 25015.017.E.3, skills acquired from supervisor jobs are highly likely to transfer to other sedentary or light work. A detailed description of the supervisory duties performed by the claimant is needed before assessing transferability of skills.

At Step 4 of Sequential Evaluation, a function-by-function comparison must be made between a claimant's PRW and their RFC/MRFC before proceeding to Step 5. It is critical for the adjudicator to make a sound and supportable determination of what the claimant can do functionally and how this relates to the physical, mental and environmental demands of PRW (POMS DI 25005.001A & B; SSR 82-62.

If the additional work development identifies PRW within the claimant’s RFC or she has the ability to transfer skills to other work, then a denial is appropriate. However, if the physical demands of the claimant’s PRW is precluded as described and as generally done; and the claimant is unable to transfer skills an allowance is warranted.
