Outcome 1
1. Explain how the range of early years setting reflect the scope and purpose of the sector
The early year’s sector in the U.K, is complex, unlike many European countries it was not developed by government policy with specific aims but came about in response to families requirements which were based on changing economic and social factors. In the second half of the twentieth century public expenditure on early year’s provision focused on families with social needs and difficulties. There was early year’s provision available in the private sector in the form of childminders, nannies and private nurseries. Families requirements for their children/ young person’s vary some parents want care for their children/ young person’s so that they can return to work, some parent/ cares want to stay with their children/ young person while they socialise, some parent/ cares want their children/ young person in setting which offer service aimed at learning, some parent/ cares want their children/ young person to be in a home based environment and some families cannot afford to pay fees for provision. This is why the early years sector has various form of provision to meet the needs of families, provision includes nurseries, childminders, pre- school, crèches, children’s centres and parent/ cares and toddle groups. Over the past ten t fifteen years the early years sector has been at the forefront of government agenda and there have been huge changes in response to social and economic

    The way that I would challenge discrimination in general is to discuss the reasons why certain practises are in place with my supervisor or with other staff who are working under me. I would attempt to provide evidence e.g. from childcare journals to demonstrate how changes can be made which help prevent discriminatory practise. If I were to observe discrimination then I might organise a team meeting or training session where I can demonstrate examples of discrimination and show staff ways that they can change their work to prevent this. If I was not able to do this I would ask my manager to provide further training on equality and diversity for all members of staff.…

    In the previous judgement the court had decided that there is no privity of contract between the appellant and the respondents since the general rule under the common law is that there is no privity of contract between the employer and the sub- contractor. The previous court has made a reference to the case of Royden (M) Sdn. Bhd V. Syarikat Pembenaan Yeoh Tiong Lay Sdn Bhd where the judge stated “ It must be borne in mind that the general rule under the common law is that there is no privity of contract between the employer and the sub-contractor.” We affirm that the decision made by trial court was right. We hereby support our argument by referring to the case of Kepong Prospecting Ltd v. Schmidt where the former federal court held that the third party cannot enforce the agreement because he was not a party to the agreement. As comparing to our case, the sub-contractor is regarded as the third party as the main contract was made between the Respondents and Ibsul Holdings Sdn Bhd. Thus, by applying the principle stated in the case of Kepong, the Appellant was not a party to the contract and therefore, there is no privity of contract between the Appellants and the Respondents.…
