Case Study 1.2: The A7D Affair Question #4: Do you think Vandivier was wrong to work up the qualification report? Explain the moral principle or principles that underlie your judgment. |

Case Study #1
“Dumping is a term apparently coined by Mother Jones magazine to refer to the practice of exporting to other countries products that have been banned or declared hazardous in the United States (Shaw, 2012).” The question is; if no law is broke, is there anything wrong with dumping? My answer would be that there is no real right or wrong. There seems to be many stipulations, when it comes to dumping, especially in multimarket and industries that deal with trades. First, we must consider why dumping takes place. “A wide array of situations can give rise to dumping. These include price discrimination, divergent market structures at home and abroad, multimarket oligopolistic interaction, entry deterrence strategy, predatory behavior, cyclical fluctuations, competitive selection of most productive firms, anticipation of future restrictions, and other factors (Rivera-Batiz & Oliva, 2003) .” Models of dumping assume that some form of market division delays goods and prevents the law of one price from holding.
Other than having considerations for dumping there are also anti-dumping laws that are in place. Antidumping policies have three main effects. “First, they benefit domestic firms because the

The advantages of antidumping cannot be ignored. Antidumping laws definitely set a benchmark for foreign companies to behave ethically. More specifically, antidumping laws prevent foreign producers from dumping their products on domestic markets at abnormally low prices by punishing them through several measures. From the firm-based consideration, there are two benefits of filing an antidumping case. First, firms can set a higher entry barrier for those leading foreign rivals so that they can protect their vested interests as well as maintain the market position. Then, firms who set an antidumping case may build a strong network with local government, as the government can gain the higher tariff against foreign rivals through antidumping laws indirectly.…

After several deaths in a small town, a local Tannery is suspected of somehow poisoning the water supply from illegally dumping out toxic waste. The Tannery and another company were later found guilty of dumping toxic waste and were fined for their actions and forced to clean up the toxic materials and restore the land they destroyed. Unfortunately, the dumping that occurred there was not the first case of illegally dumping toxic waste and it probably will not be the last. And, who knows how many countless others, that happened many years ago, are yet to be discovered. One of the biggest reasons that companies continue to illegally dump waste is that it is simply too expensive to dispose of it properly. The cost of proper disposing of the material outweigh the benefits of not. So, in other words, it decreases profits. Another thing to point out here is that even if a company gets caught, it is still less expensive to pay a fine or get a settlement agreement, than to dispose of the waste properly. The article, “The Problem of Social Cost”, addresses this issue. It says that you can regulate these companies by decreasing the amount they produce. This can be accomplished by increasing the social cost, which will lessen the demand for products that produce pollution. This in turn will assist companies in ensuring that marginal revenue is greater than marginal cost. Other…

Made in the USA- Moral JudgmentFor years, the United States has been dumping export materials and goods that have been banned or found to be hazardous to the health of the people the United States. In the case Made in the U.S.A. - Dumped in Brazil, Africa, Iraq…, the case informs about how the United States dumped fire-retardant children 's pajamas, baby pacifiers, chemicals, etc. in third world countries without their knowing of the danger they were exposing themselves to by accepting the export goods. The U.S. had this great idea to come up with a children 's pajama that would resist catching on fire. After careful examination by the US Consumer Product Safety Commission products and by products of the chemical in the material called Tris was found to cause kidney cancer in children. Then the US came out with baby pacifiers that were found to cause choking. The pacifiers were exported overseas and 400 Iraqis died and 5,000 were hospitalized after eating the fungicide on the pacifiers. Then we have Winstrol, which was a male hormone product was banned after it was found to stunt the growth of American children. Lastly when the Environmental Protection Agency (EPA) approved the sale of Galant, which was to be used as a weed killer, found that this weed killer caused cancer the EPA banned the killer in the US, but the manufacturer of the product still…

If you were a manufacturer holding a substantial inventory of a product that has been outlawed in the United States, would you have any ethical concerns about selling the product in countries that do not prohibit its sale? Suppose the inventory write-down that you will be forced to take because of the regulatory obsolescence is material- nearly a 20 percent reduction in income will result. If you can sell the inventory in a foreign market, legally, there will be no write-down and no income reduction. A reduction of that magnitude would substantially lower share market price, which in i=turn would lead your large your large, institutional shareholders to demand explanations and possibly seek changes in your company’s board of directors. In short, the write-down would set off a wave of events that would change the structure and stability of your firm. Do you now feel justified in selling the product legally in another…

The trend towards outsourcing overseas and the slowly decreasing of American manufacturing has made it very difficult to find American-made goods, but not impossible. There are a few small businesses that are still dedicated to manufacturing goods in the United States, but in today’s society, they are hard to come by. Buying goods manufacturing in the USA is something that us consumers, business owners and even the government can do to support these businesses that manufacture their products in America.…

In order to provide the Chinese home appliance manufacturers consortium with assistance in achieving their goal of improving the "Made in China" image, our first objective was to accurately define the perception of products that are "Made in China." In particular, to determine whether or not "Made in China" has a negative connotation in the U.S. marketplace and if so, to better understand the contributing factors to this perception. First, we conducted secondary research consisting of a review of literature and statistical studies. The focus was on the broader topic of a product 's country-of-origin and its effect on the consumer purchase decision process. Second, we focused on the specific impact of "Made in China" on purchase behavior. Third, to gain further insight into the consumer perception of "Made in China" in the home appliances category, we conducted primary research in the form of consumer surveys, retailer interviews and secret shopper studies. Finally, we conducted secondary research on the actions that can be taken to overcome or change a negative country-of-origin image.…

Anti-dumping laws have been around for decades. They have increased in importance in recent years and will become even more important in the future as a result of the Uruguay Round and the creation of the World Trade Organization. In my opinion, Anti-Dumping laws are inherently protectionist because they protect domestic producers at the expense of consumers. They have a chilling effect on price competition and cause the prices on a wide range of products to be higher than it would otherwise be the case, the structure of dumping calculation is such that dumping can easily occur in such situation. Great care needs to be taken in making simple calculation and proper standards should be maintained to check if dumping is occurring or not.…
