John Doe Court Cases

The cased being studied in this article discusses the occurrence of the military officer, John Doe, who is reported as an alleged abuser of his 13 year old daughter, Mary Jane. The allegations of physical abuse occurred on a Sunday afternoon when John Doe was at home on leave. He instructed his daughter,Mary Jane, to do her homework after she helped with preparing dinner. She was given an hour to complete all her homework without any mistakes. When NCO Doe came back to check on her she had not yet completed her homework and was watching television instead. John Doe decided to give her another chance of 30 minutes to complete the assignment. One the second attempt he found her still watching television and instructed her to turn it off and to continue with her homework. When NCO Doe came back for a third time, Mary Jane still had not completed her homework. …show more content…
He then turned off the television and ordered her to go to bed. Mary Jane went to school the following day with a subconjunctival hemorrhage in her proximal eye. The teacher, Mrs. Jones, noticed Mary’s eye and asked what happened to her left eye. Mary elucidating to Mrs. Jones that her father had slapped her in an impulsive manner. Mrs. Jones immediately contacted the CPS and made a report of child abuse. NCO Doe was arrested by the local police for child endangerment and CPS filled a report because of the allegation of child abuse. Medical evaluation was instructed for Mary Jane. The results from the physician are included in the article. Besides the CPS investigation, the military also did an investigation and determined that there was no full evidence of child abuse. The military decided to not offer any family services to them because no abuse was

The legal issues in this case involved the treatments of Petty, a former Police Officer who left the Metro Police Department for active duty with the United States Army. Upon his request to be reinstated, Petty was not placed in his original position as a patrol sergeant or a similar position based on the completion of the return-to-work form n which he did not disclose all the facts regarding his discharge status. The police department return-to-work process is a policy that is required for all officers to complete if they were away for an extended period of time no matter what the reason for their separation. One of the questions on the personal history questionnaire Plaintiff filled out during the return-to-work process asked: “During your absence were you arrested, charged, detained, or a suspect in any criminal action or military disciplinary action for any reason or do you have any action pending? If yes, explain in detail (use back if necessary).” Petty answered “Yes.” He also attached a narrative explanation of his response in which he admitted facing military charges in Kuwait. The narrative description did not disclose: (1) that Petty was accused of giving alcohol to an enlisted soldier; and (2) that Petty was accused of manufacturing alcohol. Since Petty did not mention facing military charges for manufacturing alcohol while in Kuwait, he was assigned to desk work. (Walsh, 2010, p.348) Under the Uniformed Services Employment and Reemployment Rights Act (USERRA), as stated in chapter 11 page 346, employers are prohibited from discriminating against member who serves in uniformed military services. The film begins with a brief overview of several women’s stories, all speaking about the reasons behind their decision to enroll in the armed forces. Typically due to familial history, or wanting to honor their believed duty as a citizen of this country, most of the women joined with a craving for the camaraderie and discipline that comes with being a member of the military. The film then shifts to in-depth analyses of two women’s stories, Kori Cioca and Hannah Sewell, and their experiences with both assault in the armed forces and the lack of victim assistance that they encountered. Lack of access to an impartial justice system, victim blaming, absence of health care for victims, unhindered advancement of their assailant’s careers, and forced expulsion from the armed forces are just some of the issues that these women faced following their attack. The film switched to focus on the institutions that essentially promote the abuse of women in the armed forces, such as the Air Force Academy, Marine Barracks, and the United States government as a whole. The U.S. government oftentimes fails to impartially prosecute and effectively address the issue of sexual assault in the military, therefore violating a woman’s rights to serve freely, and safely, for the country.
