Explain The Four Pillar Of Criminal Justice System
Police, prosecution, judiciary, and correctional institution are four pillar of criminal justice system, if one pillar gets demolished then whole justice system come to an end. Justice can be provided only when this entire four pillar are strongly interlinked with each other. Police is the most precious component of criminal justice system. If police do not perform their duty correctly then it affects the whole criminal system .Free and fair investigation is a key to provide better “justice” only. In India condition of police is worsen due to hectic schedule, stress work load, low salary, lack of proper infrastructure, technology, motivation and proper law for police.

Whenever charge sheet or arrest memo framed No photograph of accused is affixed in it which lead difficult to identify the accused in the course of trial or to trace the absconding accused therefore Charge sheet must be in digital form and attest with Aadhar card copy and latest photograph of accused, witness and person who file an FIR. There is a no fixed rule that particular amount of time should be dedicated to the investigation in a month. At time of any event all police men leave investigation and get busy in that event e.g. Election which lead to delay in justice. Poor quality of policemen is partly due to lack of proper training. Gore committee on police training observed that “our considered views is that police training, expect in some of central police organization, and is currently in a state of general neglect. The training arrangement in different states is unsatisfactory qualitatively as well as quantitatively” . Police force comes under state list. As there is a no computer network therefore FIR, reports and statement do not came in to the knowledge of higher authority they took full advantage of it. Computer chain should be setup so that work become fast and easy, FIR, charge sheet, data and progress of crime must be fed on computer and send to all nearby police station so that all other police were also aware of that crime immediately. Computer link should be setup between police and judiciary, so that judiciary aware of progress and detail of crime. If person is highly influential or rich then even higher authority do not take step against them. Supreme Court in Ganesh Narayan vs. Bangarappa case held that “The slow motion becomes much slower motion when politically powerful or high and influential persons figure as accused”. It show corruption invade in police from grass root level to higher authority. Corruption at Police Station level is affecting the timely and qualitative investigation. Corruption can only be curb at maximum level if all the work and duty of police done under surveillances. Further, the Police Stations are understaffed and the police personnel lack motivation to act without fear or favours. When the FIR is not registered within a reasonable time or the pace of Investigation is tardy, there is no internal mechanism to check this effectively. We are not telling
