Environment Protection Act, 1986
The following is the legal definition of ENVIRONMENT given in The Environment (Protection) Act, 1986:- "Environment includes water, air and land and the inter-relationship which exists among and between water, air and land. and human beings, other living creatures, plants, micro-organism and properties;"United Nations Conference on the Human Environment resulting in Legislation on Environment (Protection) Act, 1986
The "United Nations Conference on the Human Environment" held on June, 1972, thirty six (36) years ago in Stockholm led to two major environmental legislation in India; The Air (protection and control of Pollution) Act, 1981 and The Environment (Protection) Act, 1986. The acts were legislated by the Parliament of India as Central Acts. The importance of the conference on the Human Environment was such that it was the only basis on which the Act was legislated.
The preamble of the Environment (Protection) Act states "Whereas decisions were taken at the United Nations Conference on the Human Environment held at Stockholm in June, 1972, in which India participated, to take appropriate steps for the protection and improvement of human environment; And Whereas it is considered necessary further to implement the decisions aforesaid in so far as they relate to the protection and improvement of environment and the prevention of hazards to human beings, other living creatures, plants and property;" * The Air (Prevention and Control of Pollution) Act, 1981 * The Environment ( Protection) Act, 1986
The Environment ( Protection) Rules , 1986 * Manufacture, Storage, and Import of hazardous chemicals Rules, 1989 * Hazardous Waste management ( management and handling) Rules, 1989 * Biomedical Waste (management and handling) rules, 1998 * The Public Liability Insurance act, 1991 and the public liability insurance rules, 1991

    A good environment is a constitutional right of the Indian Citizens. EnvironmentalProtection has been given the constitutional status. Directive Principles of StatePolicy states that, it is the duty of the state to 'protect and improve the environmentand to safeguard the forests and wildlife of the country'. It imposes Fundamentalduty on every citizen 'to protect and improve the natural environment includingforests, lakes, rivers and wildlife'.In India, the Ministry of Environment and Forests (MoEF) is the apex administrativebody for :- (i) regulating and ensuring environmental protection; (ii) formulating theenvironmental policy framework in the country; (iii) undertaking conservation & survey of flora, fauna, forests and wildlife; and (iv) planning, promotion, co-ordination and overseeing the implementation of environmental and forestryprogrammes. The Ministry is also the Nodal agency in the country for the UnitedNations Environment Programme (UNEP). The organizational structure of the Ministrycovers number of Divisions, Directorate, Board, Subordinate Offices, AutonomousInstitutions, and Public Sector Undertakings to assist it in achieving all theseobjectives.Besides, the responsibility for prevention and control of industrial pollution isprimarily executed by the Central Pollution Control Board (CPCB) at the CentralLevel, which is a statutory authority, attached to the MoEF. The State Departmentsof Environment and State Pollution Control Boards are the designated agencies toperform this function at the State Level.Because of their impact on the environment, businesses have an obligation to try tomitigate the effects of their activities in an effort to protect the land and waterresources. As a result ultraviolet ray is getting access to our environment which will cause catastrophe for all living beings. Water pollution is another problem that we are facing now. Sea and river water is being polluted by industrial waste thrown in it. Oil seeped out from the tanks of the ships mixes with water and pollutes it. Pesticides and chemical fertilizers used by farmers are washed away by rain water and mixed with river and pond water. So existence of aquatic animals and plants is becoming hazardous. Soil is polluted by overuse of pesticides and chemical fertilizers. The polybags mix up with soil and destroy its fertility. As a result plants and crops are not growing well. So it is high time we took proper measures to stop environmental pollution and save our mother planet.…
