Ringkasan Kasus
Becton Dickinson, merupakan salah satu manufaktur terbesar supplies medis, yang mendominasi pasar suntikan dan jarum suntuikan. Pada tahun 1986, Becton Dickinson memperoleh hak khusus untuk mempatenkan suntikan yang baru di temukan oleh Charles B. Mitchell.

Tahun 1988, dengan melakukan beberapa penelitian, Becton Dickinson akhirnya memutuskan agar suntikan tersebut dipasarkan untuk melindungi lengan. Suntikan itu sebenarnya dapat digunakan untuk semua ukuran suntikan 1cc, 3 cc, 5 cc, dan 10 cc. Tetapi Perusahaan memutuskan memasarkan suntikan 3 cc untuk melindungi lengan. Suntikan 3 cc syringes di pasarkan 1988 dengan merek Safety-Lok Syringe Penggunaan suntikan 3 cc jumlahnya separuh suntikan yang biasa digunakan, tetapi meskipun ukurannya besar 5 cc dan 10 cc syringes lebih di sukai perawat ketika mengambil darah. Tetapi karena hanya Becton Dickinson yang memiliki lisensi paten dan harga dari produk suntikan tersebut mahal maka Hampir semua perawat di U.S tidak menggunakan suntikan dengan pengaman, termasuk Medical facility di mana Maryann Rockwood di kerjakan untuk mengambil darah yang terkena hepatitis B dan AIDS

Di tahun 1992, perawat Maryann Rockwood, menggunakan 5 cc syringe Becton Dickinson dan jarum untuk mengambil darah dari pasien yang di ketahui terinfeksi AIDS. Nyonya Rockwood bekerja di klinik yang menangani pasien AIDS dan dia bertugas untuk mengambil darah dari beberapa pasien. Setelah mengambil, dia mentransfer darah yang terkontaminasi AIDS tersebut untuk diseterilkan ke dalam suatu tabung yang sering di sebut Vacutainer tube dengan karet pada pipa yang dia pegang dengan tangannya. Suatu saat dia mengalami kecelakaan, jarinya tertusuk jarum yang terkontaminasi AIDS. Akibatnya nyonya Maryann dinyatakan menderita HIV positif.

AIDS menjadi dilema kesehatan termasuk diantara para dokter dan perawat. Dokter yang melakukan pembedahan pada pasien AIDS dapat mudah tertusuk jarinya dengan pisau bedah, jarum, alat tusuk,

In 1986, BectonDickinson had acquired exclusive rights to a patent for a new syringe invented byCharles B. Mothball that had a moveable protective sleeve around it.
