Abstract: Nowadays, the abolition of the capital punishment has been a common view all over the civilized world. China, a country rise abruptly (rapidly), has a great influence on the globe. Not only can it strengthen the internal legal construction, but also it meets the trend of the times. Nevertheless, there are so many factors which can not be solved in a short period of time hinder our nation 's progress toward freedom and democracy. The concept of death penalty which has been formed for 4,000 years, lack of political and economic basis , the concept of human rights has not be formed yet, all are the factors that hinder the abolition of the death penalty in China.
Above all, the concept of death penalty has been strongly rooted in the masses .Historically speaking; there has been 4,000 years since the implementation of this legal system. At the same time, Chinese people believe strongly in the notion of an "eye for an eye and a life for a life". This psychical phenomenon greatly influenced the concept of the death penalty in Chinese people. It is universally accepted that those criminal suspect who committed a serious crime deserved his capital punishment. Therefore, it is of great difficult to change the traditional ideas of death penalty, the strong call for maintening the law and justice, which has been existed for thousands of years. Besides, If china immediately abolish the death penalty, a great number of Chinese people will hold an opinion that the law was not fair. The opponents of capital punishment always equate execution with revenge, believing that if the criminal suspect who was cruel and cold-blooded can not be sentenced to death, then the justice of law can not be reflected and there is no use of law. In consequence, the abolition of the death penalty may hurt the public 's moral sentiment, as time pass there would be some attitudes of distrust of law as well as justice.
