Unit 7 Seminar Make-up
Homicide is the killing of one human being by another. (Osterburg, J. 2014). Robbery is the act of robbing a person or place. (Osterburg, J. 2014). The crime scene assessment provides the major opportunity to locate physical evidence. The initial response should be regarded as the only chance to recognize, record, and collect physical evidence. The investigator must make the most of it. This search, however, must be conducted properly and lawfully, or the evidence will be suppressed in the course of a trial. Police should not relinquish control over the scene and its environs until all evidence has been discovered, documented and collected. If it must be gone over again later, legal difficulties may be created because

The search of the crime scene is the most important phase of any investigation. Decisions of the courts restricting admissibility of testimonial evidence have significantly increased the value of physical evidence in homicide investigations. Therefore, law enforcement personnel involved in the crime scene search must arrange for the proper and effective collection of evidence at the scene. The arguments the lawyer’s will make in the William’s case is: once an item is recognized as evidence it must be properly collected and preserved for laboratory examination. However, in order for physical evidence to be admissible, it must have been legally obtained. The courts have severely restricted the right of the police to search certain homicide crime scenes without a search warrant, (Mincey v. Arizona 437 US 385, 1978).…

Some ways a crime scene may be recorded is through photographs, drawings and videography. Benefits of photographs is that the photo is taken before anything is moved, and some photos are focused on a weapon that is seen much better than in videos or drawings. Benefit of drawings is that it shows distance between objects in the room & their relationship in space to eachother. Benefits of videography is that it both records the visual elements of the scene and it can also serve as a form of notes if information is related to the recording.…

The popular television show, CSI: Crime Scene Investigations has been on the air for 12 years, and it has brought forth the behind-the-scenes actions of criminal investigations, even if its portrayals are not always scientifically accurate. This has caused an interest in the forensic sciences that has led most people to a skewed view of how a criminal investigation actually works. The reality of a criminal investigation is that it is generally more tedious and difficult than the theory of criminal investigation would have you believe. By examining the forensic and investigative procedures of the case of Pamela Foddrill, it is apparent that the theory of criminal investigation was not representative of the procedures concerning examination of the body, but that it was demonstrative of much of the investigatory steps taken by police, like search warrants. On August 18th, 1995, 44-year-old Pamela Foddrill disappeared from the town of Linton, Indiana. Pamela went to buy some groceries at the local IGA and was abducted: her body was found wrapped in a sleeping bag near Russellville, Illinois four months later. Roughly four years later, five individuals were held responsible for their part in the abduction, rape, and murder of Pamela Foddrill: Roger Long, John Redman, Jerry Russell Sr., Wanda Hubbell, and Plynia Fowler. Long, Redman, and Russell are serving life sentences, while Fowler pled out to 14 years and Hubbell pled out to 20 years of incarceration.…

In the early times, burglary was a crime of precise definition and only under certain circumstances were acts considered criminal. Furthermore, burglary was originally defined in the old common law as “breaking and entering into the dwelling or structure of another at night with an intent to commit a felony inside”. At present, by court decisions and regulation, the characterization of the crime of burglary has evolved to include many more accurate situations. To common law writers the above progression made sense because the expansion of the original concept of security of the dwelling was in response to social…

On Friday, March 3, 1843, the trial of The Queen v. Daniel McNaughton (West, Walk 12) began. The verdict of this trail changed the way the civilized world views the criminally insane. People who were criminally insane went from being viewed as evil and wild beasts to people who could not be held accountable for their actions at the time of the crime they committed. As time progressed, the insanity defense became an acceptable defense and rules were laid forth on how to declare people criminally insane. In this essay I will give the events responsible for the McNaughton trial and explain how it’s proceedings and verdict helped set forth the ground rules for the present day insanity defense.…
