Ucmj Article 86
UCMJ 86 also known as AWOL or absence without leave is defined as any member of the armed forces who without proper authorization fails to be at appointed place of duty at the time ordered. Another form of it would be if a soldier goes from that place or absents him or herself from his or her oraganization, unit, or place of duty at which he or she is ordered to be at. Such disobedient actions shall be punished as directed by a court marshall.
Going further into failing to go to appointed place of duty is a as such. A soldier was appointed a certain time and place , that soldier was aware of it and the accused without authority failed to comply. Going further into going from appointed place of duty is as such. A certain authority appointed or ordered the soldier to be at a certain place at a certain time. The soldier was aware of what time and where to be. That same soldier; without authorization went from the appointed place of duty after reported at such place.
Going further into absence from unit, organization, or place of duty is as such. The accused absented him or herself from his or her organization, unit, or place of duty at which he or she was ordered. The absence was terminated by apprehension.
Going further into abandoning watch or guard is as such. The soldier was a member of a guard, watch, or duty. The soldier absented him or herself from his or her guard, watch, or duty section. The absence of the accused was without proper authorization.
Going further into absence from unit, organizaton, or place of duty with intent to avoid maneuvers or field exercises.
Going further into Computation of duration is as follows. In computating the duration of an unauthorized absence throughout any one continuous period of absence found that adds up to more than 24 hours and no more than 48 hours combined, and so on. The hours of departure and return on different dates are assumed to be the same if not alleged and proved.
