1. What is the purpose of a trademark?
To distinguish the goods and servicesx of one trader to another. Once the trademark is registered, it provides legal protection for your brand which is protected in the whole of Australia.
2. Compare and contrat a trademark and business name
Many people are confused with the difference between a trademark and a business name.
A trade mark is what identifies the product or service. It also helps from distinguishing similar products from copy cat companies. When the trade mark is registered, it gives the owner the legal right to exclusively use or control the use of the mark for the goods and services for which it is registered.
A business name is simply a trading name only. A business name is only vaild in the state(s) it is registered in whereas a trade mark when registered covers the whole of Australia. They are different to one another as one protects the owner and the other is practically just a name.
3. How is a registered trademark indicated?
Registered trademarks are indicated using the registered trademark symbol. It is unlawful and illegal to use the symbol with a mark which has not been registered.
4. What can a consumer expect from a known trademark?
A consumer can expect: identification when making a purchase not a false or imitated design to not be misleading about the nature of the product to hold their high reputation of the trademark among the public

5. Explain the purpose of registering trademarks
Even though registering trade marks is not compulsory, it is advisable.
For businesses, it can be the most valuable marketing tool. The public will recognise the company and associate it with the products and/or services.
Registering a trademark gives you the exclusive right in Australia to establish brand identity and legally stop imitators.
A registered trademark can provide legal protection for the brand and enable you to stop other from trading with it. Once the trademark is
