1.1 legislation, guidelines and policies place duty on all those working in schools to ensure health, safety and security of children in their care. The current legislation for safeguarding the welfare of children and young people starts with all agencies working together. The UN convention on the rights of the child (1989) has set out the rights and freedoms of all children in a set of 54 articles included in those rights are those which ensure that children are safe and looked after. Those countries which signed up to the treaty in 1991 are legally bound to implement legislation which supports each article. The articles include:
All children have the right to protection from abuse
All children have the right not to be tortured The children act 1989 sets out in detail what local authorities and the courts should do to protect the welfare of children. The children’s act has some main principles that underpin it:
The welfare of the child is paramount
Parental responsibility
Court orders must be made to remove only if the first principle is not being upheld
No delay principles- if children’s cases are to go to court it must happen asap in order to protect children
The children’s act 2004 has been built on the principles of the children act 1989 it ensures:
The wishes of the children to be taken into account
A closer relationship between agencies to share information better
A children’s commissioner for England’s local safeguarding children’s boards
A duty on local authorities to ensure the educational achievement of looked after children.
The human rights act details the basic human rights of people in society:
Everyone has the right to life
To an education
The right to an opinion
This act helps to keep everyone fair and equal.
