Every year women across the world seek counsel from Equal Employment Opportunity Commission (EEOC) due to unwanted sexual advances, hostile work environment, lack of management training, neglecting to respond to employee complaints, and sex discrimination. In certain corporations such as prisons and farm houses women are seen as prey to men. Female workers have decided to not endure the harassment, unwanted advances, to be ignored by management, and not be judged or taken advantage of because of their sex. I was motivated by the two articles to bring awareness of sexual harassment by men that are in management positions and take advantage of their roles in the workplace.…

Sexual harassment is a two word phrase which hopes to never be brought up in a fire department, legally or just in conversation. It is a despicable practice that is widely acceptable around the nation in fire departments and in business. However, it is not tolerated on the legal front, nor should it ever be condoned in a professional environment. Discrimination on the basis of sexual orientation or gender is absolutely intolerable and is a plague on today’s fire service. Claims on sexual harassment arise all the time and are never short of horrendous and demeaning acts, as well as crude remarks against the plaintiff. Many legal issues arise when it comes to sexual harassment as so many aspects play into a claim of sexual harassment.…

lThere are two types of harassment: quid pro quo and hostile environment sexual harassment. Based upon the scenario, Mrs. Murphy has a legally viable claim for both quid pro quo and hostile environment sexual harassment against Personal Connections Are Us, Inc. Quid pro quo harassment occurred when the manager Dwayne Miller told Mrs. Murphy to accompany him on a trip in which they would share a room. He offered her a transfer to another department and a promotion if she exposed her breasts to him. She refused and was then demoted to the mailroom and took a pay cut. Hostile environment harassment occurred when Robert Singer, Mrs. Murphy 's co-worker, made comments about her picture in which she had a bathing suit top on. He took it a step further by taking the picture and putting it on his screensaver on his computer and made obscene edits of the picture. The likely outcome will be that Mrs. Murphy would win her sexual harassment case against People Connections Are Us, Inc.…

The Employee in the scenario Brittany Murphy feels she has become a victim of sexual harassment and has been unfairly treated at the company based on the situations that have occurred. Brittany has had interactions with her immediate supervisor Dwayne Miller and fellow employee Robert Singer, both she claims have made inappropriate actions towards her. The two types of sexual harassment that have occurred in the situation are quid pro quo and hostile environment sexual harassment. Quid pro quo sexual harassment occurs in the work environment when someone in leadership or in this case a supervisor will offer the individual an employment related benefit (promotion, raise, etc.) in exchange for a sexual favor. This situation we seen Dwayne Miller offer Brittany the opportunity to transfer to another department and promotion in exchange to stay in the same hotel and expose her breasts. Hostile environment Sexual harassment occurs when occurs when “unwelcome comments or conduct based on sex, race or other legally protected characteristics unreasonably interferes with an employee’s work performance or creates an intimidating, hostile or offensive work environment.” In this situation clearly Brittany was so upset and sick to her stomach based on the comments that Robert had made about her in a sexual manner. Brittany made it a point to ask Robert to stop and how the advances by him were unwanted but Robert kept making comments and went as far to have a picture of Brittany on his computer. There is no doubt that Brittany has a viable claim for both types of sexual harassment, the tough thing is Brittany needs to have good evidence to prove that these instances occurred wither it be through a paper trail or witnesses. The situation will be tough it comes down to one person’s word against the other as Robert claims Brittany was not giving him his calls in a timely matter which was the result of the demotion. With evidence to back up the claims Robert and Dwayne should be…
