RESERVATION IN PRIVATE SECTOR

“Reservation is against the fundamental principles of humanity, it is against the dictates of reason that a man should by reason of birth be denied or given extra privileges."
-Mahatma Gandhi-

INTRODUCTION

1. Constitution of India. The Preamble of the constitution of India embodies the resolve of the people of India to secure for all citizens: “Justice, social, economic and political; Liberty of thought, expression, belief, faith and worship; Equality of status and of opportunity; to promote among them all Fraternity assuring the dignity of the Individual and the unity of the Nation”. One of the seven categories of broad Fundamental Rights guaranteed in the constitution is the right to equality including equality before the law, prohibition of discrimination on the grounds of religion, race, race, caste, sex or place of birth, and equality of opportunity in matters of employment. However, it is declared in the Directive Principles of the State Policy that “The State shall promote with special care the educational and economic interests of the weaker sections of the people, and, in particular, of the Schedule Castes and Scheduled Tribes, and shall protect them from social injustice and all form of exploitation”. Further Article 15(4) of the Constitution provides that “Nothing in Article 15 or 29(2)….. shall prevent the State from making any special provisions for the advancement of any socially and educationally backward classes of citizens or for the Schedule Caste and Schedule Tribes”. Also, Article 16 (40 of the constitution permits the state to make “any provision for the reservation of appointments or posts in favor of any backward class of citizens which, in the opinion of the state, is not adequately represented in the services under the State”. Thus, the Constitution prescribes certain protection and safeguards for the Scheduled Castes, the Scheduled Tribes and other backward classes

Chapter three in Reservation Blues brought about some very interesting dialogue between Thomas and his new acquaintance: Chess. Invited to the Flathead Reservation to play at the Tipi Pole Tavern, Coyote Springs gave a drunken performance on stage. During the last length of their show, Thomas pulled Chess up on stage in a duet-serenade kind of thing. After Chess, and her sister Checkers, aided the three in putting their gear away, Thomas and Chess began to converse. I found the dialogue between them intriguing for two reasons. First is that Chess and Thomas, although both Native Americans, clearly have different vocabulary unknown to the other. This can be seen when Chess is talking about Junior being a good catch for a woman. Chess says to…

The Caste System determines the wealth, power and privilege of all human beings. But aside from the belief in tradition and order the Caste System brings about inequality and injustice towards many of society. Members of the higher castes enjoy all kinds of privileges, whereas the lower caste of society are deprived of all privileges, more than 160 million people in India alone are considered "Untouchable.” Oppression plays a huge role during the early ages of the Caste System. The Untouchables were made to fear all those that dominated above them, they were treated inhumanely, Untouchables live in continual fear of being publicly humiliated, paraded naked, beaten, and raped by upper-caste Hindus in reassurance to keep them in place. They were deprived all choice of social, religious, economic, cultural and political rights and privileges. This is considered inequality as the Untouchables have done nothing to deserve such punishment. Walking through an upper-caste neighbourhood is a dangerous wrongdoing. During the beginning of the 1900’s was the time in which justice…

Not much has changed with India involving the caste system since it was first introduced. The four major groups were known as the varnas but now they are called castes. Four major castes emerged from the mouth, arms, legs, and feet of Perusha (the first human being). There are four basic castes with hundreds of subdivisions. All of this which was believed in India when the caste system was first started is still believed and followed today. In modern day India the untouchables are still around and they are at the bottom of the caste system. It’s quite unfortunate for these people given that they were born into being an untouchable and can’t do anything about…

India is a Union of States and is governed by a written constitution. Rights being immunities denote that there is a guarantee that certain things cannot or ought not to be done to a person against his will. According to this concept, human beings, by virtue of their humanity, ought to be protected against unjust and degrading treatment. Thus the principle of the protection of human rights is derived from the concept of a man as a person and his relationship with an organized society, which cannot be separated from universal human nature. Human beings are rational beings. They by virtue of their being human possess certain basic and inalienable rights. We have tried to enshrine this concept by adopting a written constitution and thus ensuring people that nothing can be done to take a way the very basic essentials of human life from them even by the state.…
