Unionism Comes to the Public Sector
ABSTRACT
This paper argues that public sector labor relations is best understood in a framework that focuses on unions ' ability to shift demand curves rather than

to raise wages, as is the case in the private sector. It reviews the public sector labor relations literature and finds that: (i) public sector unionism has flourished as a result of changes in laws; (2) the effects of public sector unions on wages are likely to have been underestimated; (3) public sector unions have a somewhat different effect on wage structures than do private sector

unions; () compulsory arbitration reduces strikes with no clearcut impact on the level of wage settlements; (5) public sector unions have diverse effects on non—wage outcomes as do private sector unions.

In terms of evaluating public sector unionism, the paper argues that by raising both the cost of '

public

services (taxes) and the amount of services

public

sector unionism involves a different welfare calculus than private sector

unionism.

I. INTRODUCTION AND SUMMARY

In

the 1950s only a small minority of public sector workers were

organized and even AFL—CIO President George Meany believed "It is impossible to

bargain collectively with the government."1vjrtually no states had laws permitting collective bargaining for public employees. Strikes were

    Private sector union members are tightly regulated by the National Labor Relations Act (NLRA), passed in 1935. The law is overseen by the National Labor Relations Board (NLRB), part of the United States Department of Labor. Public sector unions are regulated partly by federal and partly by state laws. In general they have shown robust growth rates, for wages and working conditions are set through negotiations with elected local and state officials. The unions' political power thus comes into play, and of course the local government cannot threaten to move elsewhere, nor is there any threat from foreign competition.     With regards to society, Terry Moe, underlines in his article “EDUCATION: Taking on the Unions” that the teachers’ union have interests that are “often in conflict with the public interest”. Moe raises the concern that the union does not permit the riddance or even the evaluation of bad teachers, which apparently is not good for the kids and schools. As for the economy and organizations, Thomas Sowell touches on this issue by explaining that union contracts have helped put American automakers at a disadvantage compared to its Japanese competitors, resulting in General Motors “going from selling about half the cars in the country to selling about one quarter today”.     When workers are unionized they do not help the local governments, “public sector unions contribute to government bloat and to outsize compensation packages. As a result, they have created government inefficiency and bankrupted many local governments” (DiSalvo). The unions may help out the state and national government, but many local governments are affected a great deal by the unions. Many local governments are put out of businesses because they do not make enough money to afford the union fees. The local government does not have a high enough budget to afford the unions. They end up getting priced out by the state or national government, who have the high enough budget. Hence, forcing the local governments to go bankrupt. Continually, many high ranking positions in unions may not be doing their jobs correctly, but are still payed very well and will most likely not lose their jobs. In particular, “government managers generally get paid the same—and have the same likelihood of keeping their jobs—regardless of whether their operations are run efficiently” (DiSalvo). This quote shows that a government or business can be corrupt, but will most likely not get rid of the people who are corrupt because of the unions. The unions protect the rights of the workers, even the corrupt ones. This is a major problem for the government or business as it is not run as well as it could be. When the workers do not have to worry about losing their jobs, they will work less hard. Without the unions the workers feel more pressure to work harder or else they will lose their job.     Labor unions are formed by employees. The employees want better benefits and wages. In some cases they want better working conditions. There are many different needs for an employee to join a union. Over the years the use of unions have become less and less. Owing primarily to the inroads of changing technology and the resulting employment decline, as well as to changing market demands affecting manufacturing, organized labor has, it is true, lost some of its membership in recent years, both in absolute and in relative terms (Sloane, 2010).     Union membership is today at an all time low. It has been steadily declining since the 1980’s. Private sector union membership has been affected the most, while that of the public sector has remained relatively strong (Devinatz, 2011 Spring). Public worker unions, especially state and federal government unions, must be allowed to continue to bargain collectively to ensure the rights and job security of their members. Collective bargaining allows union members to have a voice regarding their wages, benefits, and working conditions. According to Raymond Hogler, in the “Labor Law Journal”, Fall 2012, “The erosion of institutions of collective bargaining will inevitably lead to a diminution of wages, benefits, and working conditions for workers” (Hogler, p. 163). Many public employees, especially teachers who work for the state, receive much lower pay than other professionals. Collective bargaining allows public employees a much needed say about their jobs, wages, and benefits. Whereas teachers, for instance, have lower pay than many other professionals, collective bargaining has ensured that they have one of the best retirement systems. In addition, collective bargaining has protected teachers’ job tenure, thus preventing them from being fired without a due process hearing and other protections.…
