Precautionary Principle

The precautionary principle was arguably developed and originally implemented in Germany and Sweden, and it is these nations that remain the leading proponents of it. For example, it was one of these nations (Germany) that put the precautionary principle on the international stage, and today with regard to environmental regulation (in particular chemicals) it is Sweden that is pushing forward precautionary legislation in the European Union. There is a conflict between those who support the principle and those who oppose it. For example, American policy-makers have become increasingly concerned with the use of the concept by the EU, seeing it as a threat to scientific risk analysis as the main tool for regulation used hitherto. Academics in the United States point out that the US had precautionary elements in their regulations during the 1970s; but these elements turned out to be excessively costly and faulty, and so were abandoned following a Supreme Court judgment in 1980 (in an infamous case concerning benzene) which insisted that regulation must depend on scientific proof of risk.

There is no one definition of the precautionary principle. One Swedish author, Per Sandin, lists 19 formulations, often individually vague and mutually contradictory.[1] The most commonly used definition is contained in the 1992 Rio Declaration, which stated that in order to protect the environment, the precautionary approach shall be widely applied by States according to their capabilities. Where there are threats of serious or irreversible damage, lack of full scientific certainty shall not be used as a reason for postponing cost-effective measures to prevent environmental degradation.

One of the more rigorous analyze of the meanings of the precautionary principle have been put forward in work by Wiener and Rogers. They argue that there are three different formulations of the precautionary principle. These are:[2]

    There is a world food crisis. Currently 790 million people are undernourished and around one third of the world’s children go to bed hungry. But their lack of food security is primarily caused by low incomes and unequal access to land, water, credit, and markets.1 There is no crisis of world food production on the horizon, despite environmental problems and a growing world population. Hunger will only be eliminated if governments and international organisations such as the World Trade Organisation implement substantial policy changes in favour of resource redistribution, poverty reduction, and food security. Technological fixes alone, such as genetically modified (GM) crops, cannot solve this problem, despite the claims which have been made for them. 2 The impact of GM crops for people in poverty, particularly in developing countries, could be negative. GM crops and related technologies are likely to consolidate control over agriculture by large producers and agro-industrial companies, to the detriment of smaller farmers. Leaving aside risk factors, GM crops could be of some benefit to poor farmers in the longer term if applications are directed to their needs and if intellectual property rules do not channel all the gains to companies. These conditions do not apply at present and require government action. There may be gains to low-income consumers flowing from reduced crop prices, if there are not effective monopolies in the supply chain.     Genetically Modified Organisms have the potential to greatly benefit the world with an endless amount of benefits but the UN is cautious around this issue, because the long-term effects of GM products are not yet known to scientists. They do not know if by alternating DNA of organisms they are in any way threatening the future of that species or even if they are introducing a new gene into the organism that can affect the environment around it. The UN has passed a treaty called the "Cartagena Protocol on Biosafety”, and it is the first global agreement to recognize the potential threat of GMOs to nature. This treaty was passed because of the fact that GMOs are relatively new and scientists have very little information so that they cannot determine what the long term effects of GM products will be. This treaty focused on the international trade with most GMOs and required exporters to be granted permission of importing countries before the shipment of GMOs. It allows the importing governments to be cautious when considering whether to let "live" GMOs like seeds and plants into their nation. It also advises that all shipments are appropriately documented and labeled "may contain GMOs." The UN would like to use GM foods to aid poor and famine struck nations with food, but because GM foods are known to cause allergic reactions in many people, the UN is hesitant in distributing GM products because of the lack of knowledge of the long-term affect that it will have on humans. With this being said, the UN is keen on planting GM crops in poorer nations because they do not require expensive pesticides, fertilizer, or food. The crop can be grown and harvested cheaply which would make food much more affordable in 3rd world nations such as many African countries as well as some Middle Eastern ones.
