INTRODUCTION
It is a critical infrastructure on which the socio – economic development of a country depends. Supply of electricity at reasonable rate is essential for overall development. Reliable and quality power at competitive rates to Indian industry is necessary to make it globally competitive. Services sector has made significant contribution to the growth of our economy. Availability of quality power is very crucial to sustained growth of this segment as well.

Exclusive dependence on government for the provision of all infrastructure services causes difficulties concerning adequate scale of investment, technical efficiency, proper enforcement of user charges, and competitive market structure. At the same time, complete reliance on private production, particularly without appropriate regulation, is also not likely to produce optimal outcomes. Therefore, in the last two decades the power sector in both developed and developing countries has been subject to restructuring. Although the approaches to reform have varied across countries, the main objective has been to improve the economic efficiency of the sector by introducing private capital, liberalizing markets and introducing new regulatory institutions.     Growing need for energy mainly driven by increasing level of urbanization and industrialization, coupled with the fiscal imperatives of the state urged the governments to take concrete actions to involve the private sector in energy infrastructure projects by the early 1980s. However, the lack of legal and regulatory framework underlying a consistent reform strategy stalled the private sector involvement in the power industry projects. Indeed the subsequent legal disputes resulted in an overall negative impression of the investment climate in Turkey. Based on the lessons learned over the last 25 years, a more structured transformation process is in the making. Indeed the enactment of the Electricity Market Law no. 4628 in 2001 and the establishment of the Energy Market Regulatory Authority (EMRA) stand as vital steps in the right direction, with the basic goal to devise a competitive framework in the market by establishing pricing mechanisms that reflected the actual cost of the service in such a way as to minimize the market-related role of the state-owned entities.     Deregulating a country's energy sector is a complicated and difficult task. The typical power utility operation is divided into three main functions: electricity generation, its transmission over the power grid and finally the distribution to the end users. Deregulation stipulates that all three functions should be open to competition. In particular, new and existing power generation utilities/companies (GenComs) should be able to compete with each other at a wholesale level. For this to be possible though, the access to the power grid should be offered with the same terms to all players.
