Personal Narrative: My Attempt Case
My recent contempt case was fairly dramatic in that I wasn’t permitted visitation for well over a year, phone communication with my daughter was essentially blocked even to the point of having her phone disconnected by the mother, I was openly referred to as a ‘Monster and a Jerk’ by the mother and perhaps the most extreme example a friend of hers on Facebook stated he should ‘try out his new concealed weapons permit when I came for visitation’. My ex-wife even ‘liked’ this comment, yet after bringing this and other facts up in Court, the Judge, ironically found me, the father, in contempt of Court and assessed a $3500 fine. The Judge's message and that of the mother's lawyer was clear, that I should understand that as a father, all of my rights

    Through my long battle with the family court system as a single father and self-represented litigant, I found that the system in California could be biased towards litigants who represent themselves. According to the California Law Review, most of the litigants are self-represented and cannot afford the prohibitively high costs for private counsel that can charge over $300 per hour and requires a retainer of approximately $5000. Litigants who take the approach of self-representation, rather private counsel usually don’t know how to defend their interests in court.     The court rooms visited were two. The first one was the video link court and the second one was summary offences court. Court one included the two female magistrates, a male magistrate and they were supported by a legally qualified court clerk. She was a woman and had all the legal knowledge required in law. The case witnessed was about the defendant named, Carl Thompson. In this case the defendant was drunk and had purchased a parking ticket, but the traffic officer gives him a fine because the car was parked outside the white line. Defendant was so frustrated that he threatened the officer while he was driving out from the parking. Defendant was already on probation at work. His father was also ill for few days ago, so his mental status was not good and he was depressed. He lost his temper and stated abusing the officer. He called the officer ‘fucking dickhead’. The defendant was guilty plea. A plea is a defendant’s formal answer to criminal charges. The judgement was made by the main lady magistrate in which accused’s probation period was extended.     The court favored my biological mother, Faith, over my dad. Even after being arrested two times for foolish actions such as drunk driving while my dad was still trying to get custody. During the custody battle Faith filed false charges against my dad saying that he had abused me while I was a baby and this was used against my dad during the battle. If it was my mother nothing would have happened. The police later found out it was a false report yet Faith still had full custody and my dad only had visitation rights. She was at the time doing a massive amount of drugs and drinking when I was in her care. My dad at no point did anything that would cause the courts to give Faith full custody. She had a tremendous amount of evidence against her to easily prove that she was not fit to be a mother my dad had nothing against him.     Finally, when I moved to New Orleans I started volunteer work at the Children’s Hospital and helped with pop up clinics for the Latino community twice. Overall I found that helping others shouldn't be something seen as duty or mandatory, it should be spontaneous. Through others experiences and hardships we learn and grow as human beings, not only did I enjoy helping others but I felt that it helped me with my problems. Having moved around so much and meet so many people and living by myself so many years I came to truly be thankful for my blessings and specially for my hardships.
