Executive Summary:

Online hotel reservation systems are increasing in importance and greatly facilitate crossborder consumer activity. The Internet has enabled hotels to contract directly with a huge number of potential customers. It has also revitalised the role of agents and lead to a new type of agent, the web agent or travel gate, selling a far wider range of accommodation on behalf of a far wider range of hotels. However, while online booking has increased the range of offers available, there are also some emerging worries due to examples of unfair commercial practices and lack of transparency related to such reservations. This study, conducted by Civic Consulting, looks at both pre-contractual and contractual matters concerning online hotel reservation systems, examines relevant Community rules, identifies gaps and, where needed, discusses possible policy options.

The primary reason for customers choosing Seven Days Inn is that it provides a complete hotel reservations system. Historically, most hotel arrangements were booked through travel agents. Although Internet bookings today are still primarily through travel agents, many are made directly with the hotel properties through websites that offer general travel arrangements or, in some instances, specifically hotel arrangements. Most consumers merely acknowledge acceptance of the extensive exculpatory language present in website booking programs without giving any thought to what would occur should problems arise. Many lawyers have had clients come to them with Internet hotel booking…

The 40% of rooms in cities were reserved online in 2009 and this rate is increasing because there is more and more online reservation system. Online reservation systems are very useful because the traveller can compare prices, can see the other travellers' opinions and ratings from the hotels and their services. In this way it is easier for the client to choose the right hotel. It saves time and money for travellers. From 2008 to 2009 the world's 30 largest hotel chains increased their online reservations with 6%, and this number is growing each year. Before, people entered directly on the hotels websites to book a room, but today, influenced by the crisis, travellers are more sensitive to prices and they prefer to compare prices and book cheaper. Also business travellers, who usually spend more than other travellers, tend to search for special offers and better prices, but with the same quality than before.
