News Story

Lynchburg police have apprehended a man believed to be the sole suspect in the murder of his mother, Diane Wagner, and attempted murder of his father, Bert Wagner, October 5, 2011.

Diane Wagner worked at a local daycare center, and Bert is a construction worker.

Twenty-year old Ben Wagner of 134 Donald Street has been charged with the murder of his mother, and attempted murder of his father.

According to police, Diane Wagner was found in the kitchen with two gunshots wounds to the chest. Bert Wagner was found in the garage, unconscious, with a gunshot wound to the leg. He was transported to Lynchburg General Hospital and is expected to make a full recovery.

After issuing an all-points bulletin, Ben was arrested, without incident, at the Shell gas station on Lee Highway at 8:21 p.m. A search of his car revealed a 9mm handgun.

Police took a statement from Bert at the hospital, and he identified his son, Ben, as the shooter.

“I lost my wife and my son,” Bert Wagner said, “Ben may still be alive, but things will never be the same. I will stand by my son’s side and continue to give him the love he has always had.”

A neighbor, Jane Smith, said, “The Wagner’s seemed like good people. They kept to themselves mostly. I never heard or saw them fighting.

According to a statement by Detective Randi Bennett, “This is the most horrific crime this city has seen in years. We are saddened at the loss of life and the arrest of a family member.”

Ben Wagner was employed at Taco Bell. He graduated Lynchburg High School in 2009 and is an only child.

Ben will appear in Lynchburg General District Court Monday, October 10,2011, to face charges of: one count first degree murder; one count attempted murder; and one count malicious wounding. His official trial date will be set at that time.
