Level 2 Award in Employment Responsibilities and Rights in Health, Social Care, Children and Young People's Settings.

Outcome 1

The aspects of employment covered by the law in Health and Social Care can include;
Minimum wage
Hours worked
Discrimination
Health and Safety
Holiday entitlements
Redundancy and dismissal
Training
Disciplinary procedures
Union rights and consultation

The main features of current employment legislation covers three main areas.
Employment Rights(Employment Rights Act 1996)
The employment rights act sets out statutory employment rights of workers and employees. It confers a number of employee rights including;
Protection from suffering a detriment in employment and time off from work for public duties
Protection of wages
Statutory minimum notice period for dismissals and reasons for dismissals
Redundancy provisions, including right to redundancy pay
Maternity rights
A right not to be unfairly dismissed
The right to receive a written statement of terms and condition of employment
Equality and Discrimination(Equality Act 2010)
The Equality Act 2010 simplifies the current laws and puts them all together in one piece of legislation. It legally protects people from discrimination in the workplace in the following areas;
Age
Disability
Gender reassignment
Marriage and civil partnership
Pregnancy and maternity
Race
Religion and belief
Sex
Sexual orientation
Health and Safety Legislation
In the Health and Social Care industry there are acts, regulations, and approved codes of practices regarding Health and Safety. These include;
Health and Safety at Work Act 1974.
Manual Handling Operations 1992 Regulations (amended 2002).
Lifting Operations and Lifting Regulations 1998
Provision and Use of Working Equipment Regulations 1998
Control of Substances Hazardous to Health 2002.
Reporting of Injuries, Diseases and Dangerous Occurrences Regulations 1995.
Health and Safety (First Aid) Regulations 1981.
