Legalization Of Abortion Research Paper
The topic of abortion has long since been debated about whether or not it is morally just, but, now with the progression of science and technology, it can be inspected with more fact and less emotion. It has gone on for far too long that those who are pro-choice can let their emotions become apart of their argument. Unfortunately, the ability to choose abortion, when made legal due to the ruling from Roe v. Wade (History of Abortion, n.d., p.1), has been legal for so long it is extremely unlikely that it could be overturned. One more factor that makes abortion so difficult to overturn in court is the large amount of support that it receives throughout the United States. This can be seen by simply turning on the news, looking at political leaders, or going online and looking at the most popular news articles "In recent years, however, the Supreme Court has begun to allow more restrictions on abortion." (History of Abortion, n.d., p.4). For instance, there can be restrictions on first trimester abortions in ways that may not be medically necessary just as long as they don't place a burden on the mother. These sort of restrictions allow for the life of the child to be saved when it becomes too close to birth. "Many states now have restrictions in place such as parental involvement, mandatory waiting periods, and biased counseling." (History of Abortion, n.d., p.4). These restrictions have helped in making abortions harder to attain which saves the lives of many babies. This topic is not only relevant in mainstream media but in the United States court system as well. "Congress has voted 81 times on issues related to a woman's right to choose, and anti-abortion advocates have won 71 of those votes." (Kennedy, 1998, p.2). The discussion of abortion will only become more heavily debated as time goes on, it is vital that all Americans educate themselves about …show more content…
Looking on the legal side of abortion very clearly shows how abortion is wrong. According to the federal government, unborn babies are considered human beings (Fetal Homicide Laws, 2013, p.2). Despite this, the Supreme Court ruled abortion a constitutional right in Roe v. Wade. This court ruling is still one of the most highly contested cases in America. Another federal law that proves abortion should be illegal is the Unborn Victims of Violence Act, which states that "anybody intentionally killing or attempting to kill an unborn child should be punished for intentionally killing or attempting to kill a human being" (Fetal Homicide Laws, 2013, p. 2). Although there are many laws and court rulings that seem to completely condemn abortion, nothing has worked yet. Antonin Scalia, a former US Supreme Court justice, stated "The right to privacy defended in Roe v. Wade is "utterly idiotic" because there is no right to privacy in the US Constitution" (Benen, 2013, p.4). This statement truly shows how unreliable the case that legalized abortion was and how it should be at the very least, looked at again. To summarize, the positions taken by those who are pro-life are very logical and factual when it comes to illegalizing abortion, unlike the side of those that are pro-choice who argue using
