Regulate the provisions of hiring Immigrants The labor laws for immigrants have changed over the past six decades. The definition of an immigrant is a person who leaves one country to settle permanently in another (“Immigrant”). Immigrants come to America to have a better life. When companies are searching for potential employees, applicants may include immigrants. Companies then should take the time to insure the legal status of their potential employee. Companies should not be permitted to hire undocumented workers due to the following reasons (1) Companies who hire undocumented workers seem to believe it has a higher leverage over its rival company. (2) Companies feel by hiring undocumented workers they have a wage impact with results in increase in supply of substitute factor input. With this factor, the employer can file the undocumented worker and limit the undocumented workers employment opportunities (accepting a lower wage than his/her productivity). (3) Although companies considered the hiring of undocumented workers beneficial, The Department of Homeland Security is currently undergoing a “silent raid” requesting companies to submit their hiring records for inspection. In 1952, The Immigration and Nationality Act admitted only a certain number of immigrants of each nationality. The U.S. Department of State provides the background of how the Act was formalized. According to The U.S. Department of State, “Republican Senator from Nevada Pat McCarren and Democrat Congressman from Pennsylvania Francis Walter, expressed concerns that the U.S could face communist infiltration through immigration and assimilated aliens could threaten the foundations of American life”.     The Immigration Act - also called the Hart-Celler Immigration Bill - of 1965 was signed by President Lyndon Johnson. This new Act phased out the Nation Origins quota system.     The immigrants that cross our borders illegally and work for low wages are depriving American citizens of the chance to seek the employment opportunities that are no longer available. Many of these immigrants work under the table and deprive the governments of the tax revenue they generate.     The underground labor market of contractors “worsened labor conditions and decreased wages for both legal and undocumented migrants.” When fear compelled employers to use contractors, both legal and illegal immigrants fell under the employment of contracting companies. A 2006 New York magazine article quotes Steven Lee, a former factory manager, admitting that he did not regret hiring undocumented workers because he needed to make a profit in an industry where his competitors also used the cheap labor of undocumented immigrants. Furthermore, the article described how, “The retailers squeeze the manufacturers, the manufacturers squeeze the contractors and the contractors squeeze the workers." Legal immigrants possessed neither the knowhow nor the finances to contest their low wages. The reduction of salaries impacted the amount of remittances sent back to Mexico.     The legal issues in this case are: there is anywhere from twelve to twenty million illegal immigrants residing in the United States illegally. As far as the ethical issues in this case, well there are so many issues I wouldn’t even know where to begin. The fact that any business would intentionally make their working environment and so poor knowing that only illegal immigrants would tolerate working there without reporting it to any agency or the legal system is beyond unethical! Now that the legal system only requires employers to use the “E-Verify” system rather than making any illegal immigrant/person provide hard copies of their citizenship. Proof of legal status can now be passed off with false names that are given to employers make our government act irresponsible which causes them to not act ethical. The information that the person provides the employer may check out in the system but in reality is not legit; and is often overlooked because it can be without consequences to the businesses. Any business that would “depress” wages so low that it causes the people who legally reside in the United States to take a huge decrease in pay because illegal immigrants that “check out” or not… are willing to work for a lot less than what the company previously paid out in salary by “overlooking” the fact that they are really just paying lower wages to undocumented workers and taking jobs from legal citizens is unethical and just bad business in respect to our US economy. In 1986 by the law allowing the proposed immigrants legal status in our country while promising that there would be tighter border patrol that would stop the flow of undocumented workers when in turn the illegal immigrant population rose from three million to twelve (or up to twenty) million is entirely unethical especially on our country’s law enforcement and laws as a whole.
