Power of Legislative Inquiry and investigation
Section 21. The Senate or the House of Representatives or any of its respective committees may conduct inquiries in aid of legislation in accordance with its duly published rules of procedure. The rights of persons appearing in, or affected by, such inquiries shall be respected. * Congress has the power to punish for contempt a person who refuses to give testimony or information pertinent to the inquiry within its jurisdiction. * Power of inquiry and investigation enables Congress to discharge effectively its primarily legislative or lawmaking functions. * Constitutional rights of persons appearing in or affected by such inquiries must be respected.

Section 22. The heads of departments may, upon their own initiative, with the consent of the President, or upon the request of either House, as the rules of each House shall provide, appear before and be heard by such House on any matter pertaining to their departments. Written questions shall be submitted to the President of the Senate or the Speaker of the House of Representatives at least three days before their scheduled appearance. Interpellations shall not be limited to written questions, but may cover matters related thereto. When the security of the State or the public interest so requires and the President so states in writing, the appearance shall be conducted in executive session. * Heads of departments cannot be required to appear before either House under pain of being declares in contempt in view of the separation of powers between the legislative and executive branches. The President may prohibit the appearance of heads of departments before Congress. * They may appear upon their own initiative with the consent of the President, or even without the consent of the President, upon the request of either House on any matter pertaining to their departments.     The legislative branch was established under Article 1 of the Constitution and consists of the Senate and the House of Representatives, collectively known as Congress, and is primarily responsible for making laws. Once a bill enters Congress, it must be passed by both houses in order to go on to the President for consideration. Currently, the House and the Senate are working on negotiations on a veterans bill “to let veterans get health care outside the Department of Veterans Affairs, including looking for ways to cover the cost” (Klimas). There are two bills circulating for approval with nearly the same intent, but due to the broad extent of the Senate bill, “conferees will need to work out the differences between the two bill”(Klimas).     In order to keep the government from becoming too powerful and endangering the liberty of its people, the framers of the United States' Constitution endorsed the implementation of separation of powers so that the different branches of the government would keep one another in check. In Federalist Paper 51, Madison focused on the crucial relationship between the legislative and executive branches with the use of separation of powers. He stated, "In the republican government the legislative authority, necessarily, predominates. The remedy for this inconvenience is, to divide the legislative into different branches...[and] the weakness of the executive may require, on the other hand, that it should be fortified." While the separation of powers has successfully protected the liberty of America's people, it has also caused a continual struggle between the executive and legislative branch to gain power over matters such as the economy, the right to pass legislation, and control over the military. Due to the prevalence of the legislative power severely limiting the authority of the executive, there is a large imbalance between the demands and expectations pressing in upon the President and his capacity to respond to them. The president cannot get his policies adopted by Congress without long delays and much bargaining. However, some fortification of the executive branch has allowed the president overcome some of these limitations in performing roles such as commander in chief, chief diplomat, and chief legislator.…

For instance, Congress has not declared war since December 1941, yet the US has been involved and engaged in many Military Campaigns since 1941 under the orders of the president.
