This week marks the final week for this course. Team 5 has discussed the ethical implications involved with accounting principles and the importance of having regulations in place in order to maintain accuracy. The following addresses some situations that may lead to unethical accounting practices as well as the effects of such behavior. The Sarbanes-Oxley Act is also addressed because of its important role of regulating accounting practices.
There are certain circumstances that can lead people to perform unethical accounting practices. If a person is dealing with financial strains in his/her personal life, has the ability and knowledge, it is possible to manipulate financial information of a corporation, this could lead to temptation. Mere greed is another motivator in unethical behavior. In any case, a person, or persons, convinces themselves that what they are doing is okay and they deserve it.

It is also based on the section of the act that may be out of compliance. Non-compliance penalties may range from the loss of D&O insurance and also the loss of exchange listings and to multi-million dollars in fines and imprisonment. This could affect the lack of investor confidence also. The CFO or CEO who may submit the incorrect certification may be subject to a fine to $1 million dollars and/or imprisonment for up to 10 years. Also if the incorrect certification was submitted “willingly” then the fine can increase up to $5 million dollars and/or imprisonment could increase to 20

Brooke Corporation and founder Robert Orr are an example of how Sarbanes Oxley (SOX) laws have not been as effective as most want to believe as based on the article, “Eight Years after the Fact is SOX working?     With the historical amount of fraud that has taken place over the last few decades, there had to be a stop of some sort to this type of unethical behavior. Through our class lectures, discussions, and readings, I have learned about the changes made to the business of accounting to ensure that the financial documentation occurred in an honest and professional manner. I would say that I am a believer that the current framework for accountants is working and does lead to more ethical behavior. The Sarbanes-Oxley Act of 2002 was a key milestone in ensuring the appropriate recording of financial information takes place. As a result of numerous scandals, SOX has made the penalties for fraudulent activity more severe, working to the benefit of accounting professionals since there can be dishonest influence placed upon them from the companies or corporations they work for. Additionally, the change to the image that has been placed upon accountants due to the scandals that took place has drastically improved. The act helped to build trust in both investors and managers that would otherwise be nervous that dishonest accounting would take place.     The best way to identify when a situation might cultivate unethical behavior in accounting is to determine the reasons why people would choose to be unethical in their accounting practices. Once you know why a person would act in a particular way then a better understanding of potential dangerous situations becomes as simply as observing and analysis individual employees.
