I researched and familiarised myself with the Employment Policies, Procedures & Guidance Handbook, which contains the Capability & Disciplinary Procedures. The Capability & Disciplinary Procedures are the means by which rules are observed and standards of conduct and performance at work are maintained, they provide fair and consistent methods of dealing with problems of conduct or work performance. Neither the disciplinary or capability procedure are designed to be punitive management tools but are intended to encourage and facilitate improvement at an early stage to ensure that conduct and performance do not become a problem that is unmanageable. The procedures allow for fair and consistent treatment of an employee and hopefully they will achieve a positive outcome to any problems.…

The accountability movement has impacted the leadership of the school organization significantly. It has forced the administrator to be more focused on data collection which reinforces the organization's position of being progressive and substantiates the staff's work. However, the candidate's administrator has proven to be inconsistent with holding certain individuals accountable choosing instead to focus on specific personnel and possible infractions, whether they have bearing on this particular area of focus or not, therefore losing sight of the true outcomes being sought. When redirection is necessary to keep the organization in compliance of the accountability measures the administrator delegates this to a committee and has limited input relying instead on the members of the committee to research, discuss and decide on a course of action. Several new committees have been added to the candidate's organization to facilitate the implementation of the necessary leadership modules needed to smoothly and successfully meet the mandated criteria. The administrator is required to provide professional development for the staff to make sure they understand their role and to assist with compliance reporting.…

The written particulars of employment that must be provided to every employee under the provisions of the Employment Rights Act 1996 must contain any disciplinary rules that do exist and indicate the person to whom employees can apply if they are dissatisfied with any disciplinary decision. If an employment contract contains a disciplinary procedure that is contractual, then failure to follow this will be a breach of contract and may result in the employee’s resignation and a claim for constructive dismissal. In addition, all employment contracts contain an implied duty of mutual trust and confidence. Failure to operate a disciplinary procedure in a fair and reasonable manner when applying a disciplinary sanction may also result in a resignation and a claim that mutual trust and confidence has been breached.…
