For this assignment I chose an article about death penalty. The author, Mario Cuomo feels that the death penalty should be outlawed. Cuomo was the governor of New York for 12 years and prevented the death penalty becoming law. He believes that the death penalty is immoral and unjust. He states that there have been many innocent people put to death and that being on death row is not as much of a deterrent as having life in prison. The article talks about how capital punishment affects races differently. Cuomo says, “Notwithstanding the execution of mass killers like Timothy McVeigh, capital punishment appears to threaten white drug dealers, white racists and white killers less frequently than those of other races. Of the last people in New York State to be executed (ending in 1963) 13 were black and one was Hispanic” (Cuomo, 2011). He thinks that life in prison is more of a deterrent than capital punishment. Inmates would rather die quickly by the electric chair or lethal injection then living the rest of their lives behind bars just to die there. I chose this article because I believe there should be capital punishment. First let me just say that there is information in the article that I can agree with but when it comes down to it we need the death penalty. I definitely think that our congress needs relook at the law. There should be a clear cut for the ones that will receive the death penalty. I think it is a deterrent to criminals. Our criminals need harsh punishment. If the criminal is going to kill a person than they need to be killed. I really think his touch on race is very biased and not sure how accurate that is. No matter what color or ethical background, laws are laws. Everyone needs to follow the laws that are in place or pay the consequence no matter how harsh.     The first method of proof I have noticed she uses very much is reference to authority. The author uses this in multiple paragraphs such as the death penalty information center, Bureau of justice statistics, sister Prejean author of the book “dead man walking”, supreme court justice Thurgood Marshall and a couple of others. This helps to make the essay seem more legitimate and people of authority agree so why aren’t we? The second method of proof she uses is statistics she uses a lot of research and cites many things mostly numerical like percentages for example “the south carried out 80% of the total executions”, “98 % of prosecutors responsible for death penalty…”, etc. This particular method supports her opinion because she is proving that pricier doesn’t always mean better. Heather is speaking of how the south carried out more executions but there was a bigger rate of murder down in the south. Finally, the last method of proof the author uses is use of comparison or contrast for example, she wrote, “if he had lived in Canada, western Europe, or most south American countries Lorenzo Norwood would have received a prison term” or “In Texas, a death penalty case costs an average of $2.3 million, about three times the cost of imprisoning a high-risk offender for forty years.” Using this methods of proof the author is brainwashing the readers into agreeing that the death penalty is costly and…

    The Eighth Amendment has stirred up many controversies with its many paths of interpretation, in that the U.S. amendments are written down on paper but sometimes not properly enforced. The 8th amendment is the one I favor least and is to be examined during this assignment. I take the double-minded position on the subject of the 8th Amendment of for and against this amendment. Is the Death Penalty an Effective Punishment? In my opinion yes, with at least one important respect, it simply cannot be argued that a killer, once executed, can ever kill again. The crime must fit the punishment in order to justify, and this punishment must not favor anyone on the foundation of color. If this were the case I would without a doubt totally agree with this amendment, however, Studies show that there are racial biases when the death penalty is carried out. Since the resumption of executions in the early 1980 's, 40 percent of those executed have been black. And more often than not blacks were more often executed than were whites without having their conviction reviewed by any higher court.     It’s so hard to say where I stand with the death penalty. There are those moments when a person commits a crime so heinous you’re in that state of mind of wanting the death penalty for them.     After analyzing Ernest Van Den Haag’s case study ‘In Defense of the Death Penalty’, and Hugo A. Bedau’s ‘The Case Against the Death Penalty’, I have conflicting feelings contradict my own analysis. Ernest Van Den Haag breaks down the pros and cons of the death penalty and uses retributivism to justify death penalty and capital punishment, while Hugo A. Bedau’s article is about the inconsistency in capital punishment and in particular on the abolition of practice.
