A very good morning ladies and gentlemen, before I get this debate going on, let me just voice out that this house believes that Custodial Sentence should not be abolished and one of the main factors of that , my beloved audience, is for the protection of public. The protection everyone in the audience and the society !

Basically, Imprisonment means to put the criminals behind bars to keep them away from the public. in this case, offenders such as murderers, rapists and robbers from whom the public clearly requires protection should be located at. Therefore long-term imprisonment sentence is an OBVIOUS solution to it.

My fellow audience, I hope you can think of this matter logically and analytically. In the UK, it is shown by the evidence gathered from express.co.uk the prison population over there is 97000 and increasing !!! So, since our very perplexed proponents are suggesting that the Custodial Sentence are to be abolished making community sentences to be given to the criminals. Now my respected audience can you imagine that this 97000 offenders are out on the open doing community service. The risk it brings to us all.

ARE you aware of what our proponents are trying to do? They are actually so confused right now. Ladies and gentlemen how can you expect a small number of policeman or officer or supervisor , in this case the UK to take control of all the prisoners who are outside at the open doing community services. Can you imagine terrorists, murderers, rapists, robbers at the old folk’s home fixing the roofs, cleaning the parks when innocent children are running around not knowing that those who are potentially dangerous are just around them? How would you feel watching criminals doing community service. Perhaps the first thought that came into your mind would be, ‘great, this guy is serving the community’, but then, the second thought that struck your mind would probably be ‘Oh MY God’, is he a murderer? Or is he a rapist, let’s stay away from

The Prison Service encompasses three central aims; holding prisoners securely, decrease risk of offending and lastly offer safe, well-ordered institutions in which prisoners are treated humanely, decently and lawfully (Cavadino and Dignan, 2007, p.193). When the state incarcerates, it must accept accountability for the basic care of those it detains. Although prisoners should not expect luxuries during their time of incarceration, they should not be deprived of the basic goods and comforts of life. Certification of access to enough goods should be available to help them develop as the citizens expected to be. Lord Justice Woolf (1991) claimed three necessities for the prison system to maintain steadiness: security, control and justice. In terms…

The penitentiary is a place of confinement and deprivation of people of a range of liberty. Inside the prison, the inmates are required to live according to the dictates of the administration that also restricts their movements (Nancy, 2006). The rules of the penitentiary control the inmates from the time they enter the prison to the time of they release. The objective of the penitentiary system is to punish and rehabilitate individuals who are involved in criminal activities to protect the public against crimes.…

Prisons are already filled beyond maximum capacity, and we continue to keep incarcerating more people. What can be done to end the problem of prison overcrowding and maintain the safety of the public? I chose this topic because I wanted to shine a light on what I consider to be an injustice. I believe that the criminal justice system needs a complete overhaul. When I chose this topic, I wasn’t fully aware of the mandatory sentencing guidelines or how harsh they were. I always believed that judges had more leeway in deciding sentencing. Originally, I hadn’t even considered the possibility of criminal corporal punishment, because I believed it was cruel and something that other less civilized countries would do, not America. I believe that the prison overcrowding problem can be resolved by changing our laws regarding nonviolent offenders, abolishing the mandatory sentencing guidelines and using alternative solutions that do not involve incarceration.…

Larkin, Jr., 2014). This option will also affect the safety of the public. As stated by Evan Bernick and Paul J. Larkin, Jr. (2014), “locking up offenders also incapacitates them for the term of their imprisonment and thereby protects the public”. In addition, the elimination of “mandatory sentences enable communities to conserve scarce enforcement resources without losing any deterrent benefit” (Bernick and Paul J. Larkin, Jr., 2014).…

Prison systems have been an intricate part of American society for centuries. As early as the act of war, imprisonment has been used to incarcerate societal wrong doers until punishment was administered. American prison systems were initially modeled from British penal methods, as America is their daughter country. British law allowed for harsh punishments and conditions for prisoners. Punishments, such as stockades and/or whippings, were perceived as effective deterrents to crime. These penalties were always public, quick, and in a form of humiliation, as well as based on capital punishment. The current idea of prison as rehabilitation, as well as restitution and retribution, is also based on British influences.…

Community corrections affect society in numerous ways. From probation and parole, to intermediate sanctions such as work release, community residential centers, nonprofit organizations, prerelease guidance centers, and partial incarceration, community corrections serve a vital role in the balance of criminal justice system in America. The prison system in America ensures Constitutional rights and humane treatment, not guaranteed in the prison systems of foreign countries. If the United States were to adopt a different prison system, there are no genuine answers if it would be beneficial or detrimental toward the war on crime that exists in this nation. In different countries, prison systems differ greatly than those existing…

It’s not enough to just lock people away and hope the problems will go away. The judicial system has to find out what is causing the crime, how best to reform criminals and what to do with those that can’t be reformed. Simply incarcerating a person will not remove the factors that led them down that road to begin with. We need to address poverty, education, social and racial issues. We need to do more than just talk about these issues. Too many people think that these are not their issues, but the truth is that these are everyone’s issues, because they do effect all of us. Crime is a prime example of it affecting everyone. Laws need to be passed to legalize medical and recreational marijuana in all fifty states. The three strike laws, truth in sentencing laws and minimum sentencing guidelines need to be abolished and the power to impose sentences should be returned to the courts. We need to view prisons as a last resort, not a first choice. Prisons should be for violent criminals who pose threats to society. People who are incarcerated should receive whatever services they need to render them functional, and prepare them if they are ever going to be released into society. In lieu of incarceration, we need to implement the decarceration courts that institute drug rehabilitation, mental health care, job placement and…

The prison system is an institution of social control. America and its politicians emphasizes punishment, the tough on crime method seems to only help the careers of most politicians in the United States, but still has not made us safer in society (Huber & Gordon, 2004) . An example of how the federal government and several states use the social control model is by changing and getting laws passed. One of the most rigorous is the California’s three strikes law just like baseball “strike out three times and you are out”! No matter what crime you commit, whether it is minor or not, the offender must be sentence to either 25 years to life in prison or triple the standard sentence (Greene & Heilburn, 2011). This law would not only increase prison population but would mostly likely lead to individuals in prison for crimes that would not fit the crime they are punished for (Greene & Heilburn, 2011). Majority of the offenders are in prisons for nonviolent crimes. This has contributed to the increase of individuals in prisons. Some states in the U.S. the federal government has ordered state prisons to reduce their prisons by 40,000 inmates (Pew, 2008). This makes me sick in the inside, because it makes me wonder maybe these individuals didn’t need to be in prison in the first place, if they are releasing such a large number of…

A custodial sentence is a judicial sentence imposing as a punishment, consisting of mandatory custody of the convict, either in prison or in the some other therapeutic or re(educational) institution such as reformatory, psychiatry or drug detoxification. The main reason why we strongly believe that the custodial sentence should not be abolished is that it serves as justice to the victim of the crimes. And what does justice really means by? Justice is defined as a judgment and punishment of a party who has allegedly wronged others. As Quoted by the renowned Martin Luther king, injustice anywhere is a threat to justice everywhere. That is what the non-custodial sentence actually is, an injustice towards the victims by giving lenient sentence to the criminals. Justice is to be given to the victims and not to those criminals who were fully aware of its consequences. Besides, criminals know the consequences of their actions as they have a mind. Those factors are the protection of public, deterrence of crime and as punishment for criminals on their wrongdoings. The main focus about custodial sentence is about retribution towards the criminals.…
