Contract Reflection
After four weeks of studying, I found it that I am comfortable with week 2 and week 3, but I struggled with week 1 and week 4. Since my background is different from others, and China has few in common with the American law system, I found it very difficult to understand the law structure and the UCC sales. In the other hand, I had a few jobs in a special field, and I have run into some problems which are related to torts and contract, I think week two and three are more understandable for me.
The contracts that I have encountered with are work contract and lease contract. My very first job in America was working in a tribal casino as a dealer. Contract is following the federal or state statue, it is a very important role in the business because it is a basic rule to regulate employee. The contract I signed with the casino is under the protection of the federal government. The United States constitution provides for a federal government that is superior to state governments with regard its enumerated power. Therefore, whenever there is a conflict happened within the contract, we should look answers in the federal law instead of state law. In the other side, the lease contract is following the state law.
In the beginning the working, I received a book of gaming rule which tells us how to deal cards in the house way. The gaming book has a copyright which is the right of literary property as recognized and sanctioned by positive law. No one can publish it or use it on any purpose. Later on, there was an intentional tort happened. I reported my supervisor of sexual harassment, but he made a defamation statement against me saying I called him first. It damaged my reputation and indirectly caused the termination of my employment. The casino fired me of employment at will which they did not notice me in advance.
