The Land Registration Act 2002 has actually replaced the previous legislation in particular The land Registration Act 1925 which governed and earlier though similar system but with the new statute now governs all matters concerning registered title. The Land Registration Act 2002 was introduced in response to the Law Commission and HM Land Registry report, Land Registration for the 21st(2002)1. The Land Registration Act 2002 came in to force on October 13th 2003 . Its main objective is to provide a complete and accurate reflection of the ownership of land. It has also been suggested that it should be possible to investigate this ownership online, keeping enquiries and inspections to a minimum. The Law Commission acknowledge that ‘absolute’ registration is unrealistic, but the new legislation will have a considerable impact on the commercial property market.2
The Land Registration Act are a very familiar piece of legislation to conveyancing solicitors in conveyancing practise and set out formal processes and requiments of land registration for conveyacing solicitor and conveyacing practitioner. It is now compulsory to register all land and overriding interests in land as part of the conveyancing process on transfer of a property from one owner to another and the Land Registration Acts set out how the registration process should be dealt with by convenyancing solicitors3.Why is registration important? “Registration establishes proof of ownnership and produces an easy-to-read document reflecting the contents of all the paper titlte deeds. The simplifies convenyancing making transactions easier and potentially less costly for all involved” All title information is kept on Land Registy’s database, reducing the need to store old and often unclear deeds. The register can be viewed quickly and securely online. There is no better way to safeguard ownership of land and property than by registering.4

    In 1925, Parliament introduced a system of land title registration, where the title to land across England and Wales would be compiled. The Land Registration Act 1925 ('LRA 1925') planned to create a 'one-stop shop', to eventually eradicate the need for individual title deeds. Subsequently, the Land Registration Act 2002 ('LRA 2002') set out the law of land registration, representing an attempt to improve and modernize the relevant legislation.     1. Distinguishing between fixtures and chattels is important when deciding who the legal owner of property is. A fixture is an object which is attached irreversibly to the land, the removal of a fixture would result in the damage of the object. However the description of a describes how a chattel is not fixed it is an independent object resting on the land, and can be removed without causing damage. The distinction between whether an object is a fixture or a chattel is decided based upon to tests, the first “the degree of annexation test”, looks at the degree of the joint between the object and the land. If an object is fixed permanently to the land and removal will cause damage, the object is a fixture as in the case of Holland v Hodgson (1872). However if it is found that the object is merely resting on the land by its own weight then it’s a chattel, as was decided in Hulme v Bingham (1943). The second test “the purpose of annexation” looks at reasons why the object was joint to the land and whether it was placed to improve the property. An example of where distinguishing between a chattel and a fixture could be very important would be during the selling and buying of property or land. The owner looking to sell the property may believe that some objects within the property or on the land are not part of the property and therefore not part of the sale, whilst the buyer may be of the opinion that the object is in fact part of the land and therefore on sale they will become the legal owner. In cases like this is it important to distinguish between the two.…

    The English Land Law is one of the oldest branches found in the doctrine of common law. It has its origins in the feudal reforms imposed on England by William the Conqueror during the Norman Conquest after 1066.1 The Conquest brought with it a sharp distinction which still exists, technically between land and chattels. Chattels are things that can be owned; land cannot be owned, except by the monarch. If a private citizen cannot 'own' land, what is it that we really do own when we think of ourselves as 'land-owners'? Technically, we own what lawyers call an estate in land.2 Although 'estate' is a general term with an everyday meaning, in this context it has a specialist interpretation. An estate in land is some package of rights over land, and responsibilities accompanying those rights. These rights, by definition, fall short of absolute ownership, that is, they held their grants of land directly from th­­e king.3 These rights included the right to enjoy an income from the agricultural production of the land, and were accompanied by certain obligations to the king. The estate defined the duration of the rights enjoyed by its owner, and the accompanying responsibilities. Consequently, the tenant-in-chief would create lesser tenancies out of his larger estate, and grant them to people who were prepared to accept obligations towards him.…
