IN THE UNITED STATES DISTRICT COURT FOR THE NORTHERN DISTRICT OF ILLINOIS JUSTIN WILLIAM KING, ) ) Plaintiff. ) ) ) v. ) ) ANHEUSER-BUSCH COMPANIES, INC. ) ) Defendant. ) ____________________________________) COMPLAINT Comes Now the plaintiff, Justin King, by and through his attorney, states as follows: PARTIES AND JURISDICTION 1. Plaintiff, for all times mentioned herein, was and is a resident of Cook County, State of Illinois. 2. Defendant is a corporation with its principal place of business in Missouri and carries on business in Illinois. 3. This court has subject matter jurisdiction over the claims presented in this complaint under 28 U.S.C. § 1332 because plaintiff is a resident of Illinois and the defendant is a citizen of Missouri and the amount in controversy exceeds $75,000, exclusive of fees and costs. 4. Personal jurisdiction and venue are proper in this District pursuant to 28 U.S.C. § 1391 because the acts of defendant caused harm to plaintiff in Cook County, in United States Court for the Northern District of Illinois. COUNT I: ________ 5. On or about April 8, 2011, plaintiff Justin King, while in the exercise of due care, was operating his motorcycle on Interstate 57, heading in a south direction, in the City of Paxton, Illinois. 6. On the occasion in question, defendant, Frank Cuellar, a resident of Illinois, was operating a truck owned by Anheuser-Busch as its agent, and was traveling in a south direction on Interstate 57, so called, a public highway in the City of Paxton, Illinois. 7. On the occasion in question, plaintiff Justin King was traveling south on Interstate 57 in Paxton, IL on his motorcycle when he noticed a truck with Anheuser-Busch logo traveling behind him headed in the same direction. The plaintiff noticed Mr. Cuellar flashing his headlights requesting to pass the plaintiff and proceeded to switch lanes. Justin King then changed lanes to the right hand lane

    When dealing with a case loads that has doubled to the point o the staff being not able to handle it, it could arise many of problem in not just the criminal division but in all aspect and areas of the courts. Having fifty employees under the active administrator for the court may sound like a lot, however it can be depending on the size of the court and the work load that is given in the courthouse on the daily basis. Having a double in a workload can make many issues arise in the court when dealing with criminal cases, because it is taking too long to reach final disposition. What normally takes one month has almost doubled in time making everything build up and the more time it takes to get to that point, the more money it ‘s going to be for not the lawyers, but also for both parties (plaintiff and defendant). With only two judges things are going to take time and the process of the filling paperwork is going to be in abundance for the judges and the clerks. What can also cause another conflict is, if there is going to two judges hearing criminal cases and at the end of the one month period, what will happen when one of the judges doesn’t get done and reach their deposition until three months ? Meaning one of the criminal case judges is going to have to wait for two month in order to rotate onto the criminal bench, which can cause a major situation? By having such a massive work load there are going to be many tempers flaring in the criminal case proceeding because they feel the process is taking too long. Nonetheless, some and/or maybe both parties will get tired and wonder why the dragging out for so long is. As time goes on there is going to have to be another way to handle the workload as well as making sure things run at respectable time frame before things get so backed up, to the point of hiring more staff to make things go a little faster and easier.…

    The reformation of the civil justice system in 1998 was as result of the issues identified by Lord Woolf as hindrances to effective civil litigation. Prior to Woolf report, it was perceived that civil litigation has two main problems; cost of litigation and the duration of court proceedings.
