Chinese Labor Relations

Labor relations in China have become more and more complex, labor conflicts have occurred frequently, and thus labor disputes have been growing with a rate much faster than that of the development of GDP in the past decade. They could become a potential obstacle to the economic development if not appropriately managed. The paper studies the condition of labor relations, and probes the profound reasons for it, and compares it across the world in order to give a description for it.
1. CONDITION OF LABOR RELATIONS IN CHINA
Since the mid of 1990s, accompanied with the deepening of economy reform of China, most social and economic relationships have been undergoing formidable transformation and the social and living style of some community have been greatly changed. The creation of new glossaries such as rural workers, lay-off, work, reemployment reflected the transformation of the period. The simple and harmonic labor relation between the state-owned enterprises and the workers in the system of planned economy has been gradually substituted by that between the employees and the employers of various of different ownerships, underlying the transformation of labor conflicts. The development of labor conflicts could be evidenced by the growing of labor disputes. In accordance with the China Labor Statistical Yearbook, from 1995 to 2012 the labor disputes had grown by 6.9 times, from 33 thousand to 260 thousand per year with an annual growing rate of 31.05 percent, which was 3.6 times the average growing rate of GOP of 8.7 percent at the same time.
In this period, accompanied with the deepening of reform of state-owned enterprises, and the constant development of economy within non-public section, the variation of labor relations and the emergency of labor conflicts drew public attention. Some scholars, labor unions and national authorities of statistics investigated the labor conditions and published many reports, which offer invaluable

    Companies that operate across national boundaries often need to work with unions in more than one country. Organizations establish policies and goals for labor relations, for overseeing labor agreements, and for monitoring labor performance. The day-to-day decisions about labor relations are usually handled by each foreign subsidiary. The reason is that labor relations on an international scale involve differences in laws, attitudes, and economic systems, as well as differences in negotiation styles. At least in comparison with European organizations, U.S. organizations exert more centralized control over labor relations in the various countries where they operate. U.S. management therefore must recognize differences in how various countries understand and regulate labor relations. For example, in the United States, collective bargaining usually involves negotiations between a union local and an organization’s management, but in Sweden and Germany, collective bargaining generally involves negotiations between an employers’ organization and a union representing an entire industry’s employees. Legal differences range from who may form a union to how much latitude an organization is allowed in laying off workers. In China, for example, the government recently passed a law requiring employers to give new employees shorter probationary periods, consider workers’ dependents in making layoff decisions, pay severance to fired workers, and give the Communist Party–run union more power in negotiating contracts and work rules. In Germany, because labor representatives participate on companies’ boards of directors, the way management handles labor relations can affect a broad range of decisions. Management therefore has an incentive to build cooperative relationships.…

    Before the industrialization movement began, there was more of a blend between the classes, and now there is a distinct separation between the bourgeoisie and the proletariat. Because of the industrialization of the countries, the replacement of manual labor with the use of machinery and the division of labor, the work of the proletarian has become homogeneous.     "Labor market" can be defined as the mechanism in which workers compete for jobs and employers compete for workers. In a labor market, wages, benefits and responsibilities of workers are bought and sold. Unlike traditional markets however, labor is not a good that can be differentiated by conventional rules of supply and demand. While workers are the suppliers and employers are the buyers, overall supply cannot be manufactured as people only have a limited amount of time in a day. Additionally, companies are strong and can often directly manipulate the market by setting strict labor rules, triggering potential reductions in any supply side scarcity. A single employee is defenseless within this complicated environment. To balance the employment relationship, the National Labor Relations Act allows workers to unite. Through the formation of a union, workers can create resources and seek out benefits with much more success and efficiency than if they sought these advantages individually.
