TUTORIAL 2
1. Stevie G was shopping in a departmental store when he saw a bottle of cologne he liked. He put it in his shopping basket. He then went up to the 3rd floor of the store to carry on with his shopping. He changed his mind about the cologne and put it back on the shelf. Michael O, who works for the store, sees this happening and insists that Stevie pay for the cologne. Is Michael O right? Give your reasons.
2. Rahman is at an auction when he sees a Manchester United shirt. The starting bid is RM 1.00. Rahman raises his hand and the auctioneer asks whether there are higher bids. There is none. The auctioneer says “Going to the gentleman who has bid RM 1.00…going…going…” but before he could say “Gone”, Rahman withdraws the bid. The auction house wants to sue Rahman for non-payment. Is Rahman liable? Would your advice be different had Rahman attempted to withdraw his bid after the gavel had hit the auctioneer’s desk?
3. Britney sends an email to Santana, offering to sell her Madonna CD for RM 30.00. Santana accepts. Britney changes her mind and emails Santana saying that she has sold the CD to Rachel. Discuss.
4. Robert wants to buy Shanti’s contract textbook. Shanti wants to sell her textbook to Robert. They agree on a price of RM 30.00. Robert thinks Shanti is selling the Law of Contract by Karl Kennedy. Shanti thinks Robert wants to buy her textbook the Law of Contract by Susan Kennedy. Advise the parties.
5. Wayne is 17 years old. He has the intelligence of a 6 year old child. Alex persuades Wayne to enter into a contract for the purchase of an exercise machine. Wayne is not able to pay the full sum. Advise Wayne. Assume that Wayne is 19 years old. Would your advice be any different?
6. Colleen, who is 16, wants to be a fashion designer. She obtains a scholarship to go the Limkokwing Institute from the Fair & Lovely Group. Fair & Lovely have given the scholarship to someone else. Can Colleen sue them? Colleen also orders a Balenciaga
