1. Identify and describe the specific issues DeMur encountered in the workplace. Do the actions of other workers at Treton represent discrimination and harassment? What elements of law are important for Treton to consider? DeMur found very clear issues that can relate to Harassment and Equal Employment Opportunity discrimination within his work place. It started when his supervisor was hesitant to grant him days off for a religious event. This event was something that the supervisor did not know and did not understand why DeMur would want to join this religion. Jenkins, who is DeMur’s supervisor, said that he was a religious person and called his a “so called religion.” After a period of time, he was granted his time off for his religious pilgrimage. His fellow colleagues would taunt him about his religious beliefs by calling it “witchcraft and sorcery.” Even though DeMur was taking the abuse he did not say anything about it. The supervisor was aware of the situation and was allowing it to happen. After his religious encounter, DeMur came back to work and was given a new name, Maalick. This was the spiritual name that he was given to from his spiritual retreat and he wanted to be known by Maalick only. On his first day, he went to the Human Resources department to legally change his name. After he came back to his office, his co-workers had decorated with African tribal pictures and voodoo, mocking what Maalick now believes in.
From the very beginning, when the supervisor was hesitant on giving the days off because of a religious purpose that was not of his own affiliation was not a good starting point. Then after being aware that the employees were taunting DeMur about it is another ground for punishment. These actions all represent discrimination and harassment as defined in the firm’s own policy. The Federal Equal Employment Opportunity Commission (2014) that is based on Title VII of the Civil Right

As you are embossed in this culture, you begin to take on the traits, beliefs and practices associated with it. You are fully immersed into your religion which now becomes second nature to you. You are taught that God helps people in need and looks out for all those who worship him. As you grow older, you believe more and more that your religious practice is what gets you through. You are now an adult and finally have the opportunity to live on your own. You’ve just been hired by a fortune 500 company and you are ecstatic because, it is your belief that God is the reason you were put in that position. As you report in to your first day of work, you realize that it is all you have ever wanted and you pray to thank God for the opportunity that he has provided you. You feel a tap on the shoulder and there is your supervisor telling you that you cannot pray in the office as it is prohibited by company rules. Many of your co-workers see this and they approach you at lunch time. They all feel your pain because they too have been told that due to company policy they also could not practice their religion at work. This is a problem. You realize that growing up in a Utilitarian environment urges you to fix this problem for the greater good of all the people working in this office. Religion should be allowed in the workplace to ensure that all people are afforded the opportunity to worship as they choose, within guidelines.     Under Title VII of federal employment laws, it states that the employer has the duty to try to find a way to avoid conflict between workplace policies and an employee’s religious practices or beliefs (Bennett-Alexander & Hartman, 2007). The employee may wish not to work on a particular day because it is the employee 's Sabbath. Title VII requires only reasonable accommodation of an employee’s religious practices, not satisfaction of an employee’s every desire (Bennett-Alexander & Hartman, 2007). In the case of Frazee vs. Illinois Department of Employment Security, the plaintiff, who is a Christian, refused a job through Kelly Services because he considered Sunday as the Lord’s Day. His unemployment insurance was terminated because of his refusal to accept an offer for employment. He appealed the decision and lost because the Illinois Appellate Court found that in accordance with federal law, “the injunction against Sunday labor must be found in a tenet or dogma of an established religious sect.     Constructive discharge is relevant as a legal concept in this case according to Title VII which states that it is unlawful “to discharge, or otherwise to discriminate against any individual with respect to his compensation, terms, conditions, or privileges of employment, because of such individual’s race, color, religion sex or national origin.” In the described case, arrangements were made to increase factory production by requiring employees to work four 12 hour shift on any day of the week which the said employee states directly affected their religious obligations.     Title VII of the Civil Rights Act of 1964 is a federal law that protects individuals from discrimination based on religion. Religious discrimination is treating a person differently because of their religious believes. In this case Elaine Mobley, a member of the nonsectarian Unitarian Universalist Church, can file a legal sue under religious discrimination or the Civil Rights Act of 1964, because she was discriminated by employees and her supervisor. They said that she would be “making efforts repeatedly to “save the soul” of a fellow employee” (Neill, 2014, Web). A proven wrongful dismissal will tend to lead to two main remedies: reinstatement of the dismissed employee, and/or monetary compensation for the wrongfully dismissed. In this case the court should look on how Elaine Mobley told her supervisor that she was feeling harassed by her employees, and shortly after that she was fired.
