Case Analysis #1 I would confront my boss privately and let him know that I am uncomfortable with how the documents were obtained and what possession of them would say about our company’s culture. Although having possession of these documents would benefit the company, it could result into a public relations nightmare if anyone were to find out about this tactic. It is a big risk to obtain a competitor’s confidential document, but to use those documents would be a disaster since it could ruin the company’s reputation. It will show that the company is a failure for stooping to that level and it will also take a while for them to bring their reputation back to where it was. It may seem like an advantage for the company to use the competitor’s confidential documents, but the way I see is that the competitors will actually be at an advantage when the public finds out about this tactic because consumers will not be drawn to you anymore. The company cannot create a high-performance culture if there are no values, and in order to do so, I would just let my boss know that I will not use the competitor’s confidential documents so we can do this the right way. I want to be a cultural leader and drive the company to excellence the right way because it will exemplify us to be a strong culture. Culture has a significant impact on performance so by putting emphasis on cultural values, it will affect the business performance positively which would drive the company to success.

    Schmidt, a South Carolina citizen, sued Wachovia Bank in a South Carolina state court for fraudulently inducing him to participate in an illegal tax shelter. Wachovia is a national bank with its main office in North Carolina and branch offices in several other states, including South Carolina. Under federal diversity jurisdiction, federal courts can hear cases in which the parties are citizens of different states. Wachovia filed a petition in Federal District Court, seeking to compel arbitration of the dispute. After the petition was denied on the merits, Wachovia appealed to the Fourth Circuit Court of Appeals, which dismissed the case for lack of jurisdiction. Under 28 U.S.C. Section 1348, national banks are "deemed citizens of the States in which they are respectively located." The Circuit Court interpreted "located" to mean any state where the bank has a branch location. Noting that the statute uses both "located" and "established" to refer to the presence of a bank, the Circuit Court determined that a national bank is "established" in the state where its main office is located, and "located" in every state where it has a branch office. Therefore, under the Fourth Circuit's reasoning, Wachovia was "located" in, and a citizen of, South Carolina (as well as several other states with branch offices). Since both parties, Schmidt and Wachovia, had South Carolina citizenship, the Circuit Court dismissed the case for lack of diversity jurisdiction.…

    Firstly, Alejandro’s team members did not view him as an authentic leader. They had no respect for or confidence in him probably because they sensed his self doubt so they disregarded his plan and did not pay attention.
