1. ABC Company has hired you as the Human Resource Manager. Though the company has experienced sales growth in each of the last four years a hiring freeze has been in place. That freeze has been lifted and it is clear that some departments are understaffed.
Chapter 10 in the e-text describes the role and functions of human resource management. In one paragraph, describe the plan and activities you will use to determine the personnel needs of ABC Company. First is what are the needs of the company; deciding what types of individuals are need in order to suite the companies demands and conserve the expenses of hire. Then what types of individuals are going to be selected, going through applications, resumes and once selected their references. Setting up interviews, and scaling employees for those best suited, consulting with department managers and having them perform their own interviews if necessary. Performing job offers and salary/benefits negations to signing contact papers of the details of the job expectations, employee benefits, salary, and all other details that the position may include. In order to fulfill my needs as an HR manager I would first, assess the past, current, and future projections of the company and its needs. Then I would look at economic growth or decline and see how that has affected the course of business followed by forecasting the internal employees and the external employees against the trends of the company. Are employees happy or is there high turnover? After this would become the recruitment phase in which advertisements for hire would need to be placed among the market.
2. Chapter 8 in the e-text addresses models and concepts of employee motivation, providing strategies and techniques for improving motivation.

There was a valid contract formed between Pierre’s and Maynard because an agreement was made that had an offer of a contract and an acceptance of the offer (Mallor, Barnes, Bowers,& Langvardt, 2012). For a contract to be valid it must contain four parts. In this case the first part of the agreement was made between the two parties when Pierre’s offered Maynard a 1979 Mustang at the price of $4000, a $1000 discount, if he purchased the car that day. Secondly, the consideration was also made by Maynard because he agreed to purchase the car that very day. Thirdly, Maynard was also legally competent and of age when he went into agreement with Pierre’s. The fourth and final part of the contract was made when Maynard signed the binding legal contract provided by Pierre’s. Since the contract was formed Maynard does not have any arguments to have his money refunded because the contract stated the car is being purchased with the clause of “As-Is” which means that no matter what he thought the condition of the car was he was purchasing it without any arguments that may or may not have affected his signing of the contract. Since the clause was part of the agreement Maynard will not be able to get his money back. With respect to the Uniform Commercial Code, or UCC because Maynard purchased goods with the “as-is” clause, it implies there are no implied warranties and the car is purchased with all the parts it includes (“U.C.C. - ARTICLE 2”, 2003). If Maynard had test drove the Mustang prior to signing he would have realized the breaks were not in the best condition and he could have possibly had a case against Pierre’s because they stated that "the engine and brakes are in tip-top shape" when this was hardly the case. Also Maynard should have looked up what the value of the Mustang was to see if he was getting a good deal and inspected the vehicle a little better rather than rushing into the sale. As far as the behaviors of…

Although it is sometimes thought that Intellectual Property Law originates with the invention of the computer and the accompanying software used to operate it, but the origins of Intellectual Property or commonly referred to as (IP) date back many centuries to medieval Europe and much of what was established during that period was transported with the early colonists of the United States. Prior to the ratification of the Constitution, each colony has their own set of rules and governance for copyrights and patents; however, since each state had their own set of governance, IP was not portable from state to state. With the ratification of the Constitution the Federal Government established a central entity by which IP could be governed and regulated (History and Sources of Intellectual Property Law). Approximately “twenty five years ago a vigorous debate raged in the US legal academia over whether software should be covered by patent or copyright or some third option” (Boyle, 2009). The law distinguishes among three types of property, real property, personal property and intellectual property. Real property being the plot or/and estate, personal property which is identified as the possessions owned which may be transportable such as furniture, cars, etc. and intellectual property Intellectual property means any patent, copyright, trademark, design, technical or commercial information or any other intellectual property or any license under or in respect of any such right, which is various legal entitlement which attach to certain types of information, ideas, or other intangibles in their expressed form. Even though Intellectual Property is an umbrella term that governs all non-tangible ideas and information to be patented, what criteria is used to determine whether the…

For this project, I will be writing about the various ways in resolving personality conflicts in an organization. There are conflicts which deal with personalities, discrimination and leadership. These are common situations to any organization. At my company, a conflict arises due to the mere fact that one believes the research of a Teflon product made by Boston Science Guys Corporation is stronger than the other Teflon product made by Johnson & Joe, Inc. Here are two heated employees in a debate that one knows more about a Teflon manufactured product than the other. This situation will need to have a neutral person involved to view the differences regarding the disagreement which creates a conflict of interest of the organization. That is where I step in when a situation arises. In order for me to facilitate all individuals involved, the cooperation from all will be needed. During this process, a meeting will be schedule and conducted to have both employees describe the escalated debate of something that could have been handled in a better way by both employees. If there is any sense of unwillingness, an appointed manager or supervisor of that particular department will be the person to defuse the situation in order to resolve the conflict. My input will be valued in order to move forward with an objective of what the goals of this organization needs in resolving any conflict that arises from any situation. My consultation will consist of objectives, procedures, collaboration, training, and solutions. An outline of my project is as follows:…
