Bullying both in and out of public schools is an increasing epidemic among our school age children. It knows no boundaries and can have detrimental and lasting affects upon its victims. Bullying is not a new phenomenon and has been prevalent both in and out of school systems for many years. The description of bullying now has taken on new facets and categories. Not only can it be categorized into physical, written or verbal categories, but now it is taking on an electronic form. The State of Delaware has developed laws and practices to which school systems must abide in order to not only alleviate, but also help to recognize both the victims of bullying as well as the perpetrators. The state approved Senate Bill 193 to develop a cyberbullying policy. It also allowed the attorney general’s office to defend schools that face a legal challenge after implementing a new Cyberbullying policy ("http://www.newsworks.org/index.php/local//delaware-feature/52160-cyberbullying-just-as-serious-as-physical-bullying-in-delaware- ," ). This legislation provides for the development of a statewide, fact-based cyberbullying policy to be adopted by local school districts and charter schools. It also provides a means for the Department of Justice to assist in the defense of a district or school whose use of that statewide cyberbullying policy is subject to legal challenge. More specifically, the statewide cyberbullying policy which went into effect in March of
