The Affordable Care Act
The Patient Protection and Affordable Care Act (PPACA) or Affordable Care Act (ACA) is a health care reform law that was voted into enactment in March of 2010 (Summary of the Affordable Care Act, 2013). The ACA consists of many different parts of which come from the Affordable Health Care for America Act, the Patient Protection Act various parts of the Health Care and Education Reconciliation Act and the Student Aid and Fiscal Responsibility Act (Affordable Care Act Summary, n.d.). The original goal of the ACA was to cut back on the amount of dollars that was being spent on health care while making an attempt to get the people back in control of their insurance needs (About the Law, n.d.). It has sections dedicated to emphasizing changes to benefits, the rights and protections of the people, new rules for insurance companies to follow, taxes and tax breaks for companies and individuals, ideas about government funding, spending and the creation of committees. There are even sections dedicated to education (Affordable Care Act Summary, n.d.).
The ACA is a complicated piece of legislation made up of many different provisions and regulations. Within this paper I will be discussing five of these provisions and three of the regulations that are either pending or existing. I will also be looking into two federal cases related to the constitutionality of the ACA - National Federation of Business v. Sebelius and Burwell v. Hobby Lobby.
Five Provisions of the ACA The five provisions that will be discussed within this section are; Title I - Quality, Affordable Health Care for All Americans, Title III-Improving the Quality and Efficiency of Health Care, Title V – Health Care Workforce, Title VII – Improving Access to Innovative Medical Therapies and Title IX – Revenue Provisions.     The Patient Protection and Affordable Care Act (PPACA) signed into law by president Obama on March 23, 2010 is arguably the most extensive reform of health care law ever to be enacted in the U.S. It will impact the way professionals practice health care, the way insurance companies handle health care as a product, and the way consumers purchase and use health care as a service. The Affordable Health Care Act is primarily aimed at reducing the number of uninsured Americans and reducing the overall costs of health care from an administrative and consumer standpoint. The PPACA requires insurance companies to cover all applicants and offer the same rates to all applicants of the same age regardless of pre-existing conditions, gender or any other intrinsic factors that may deem an individual a particularly “risky” investment for an insurance company. According to the U.S. Census Bureau, in 2009, there were 50.7 million Americans living without health insurance; that amounts to 16.7% of the population (DeNavas-Walt et al.). In order to increase the rate of coverage, the PPACA provides mandates, subsidies, and tax credits to employers and individuals. Since individuals will not be discriminated against on the basis of their health, insurance companies will have larger pools of individuals to cover and the price of insurance will decrease based on the idea that the collective or average risk of any given group of individuals will, theoretically speaking, be less risky than the highest-risk individuals in that group. Because consumers will not be judged on their individual health, the insurance companies, instead, will have to compete for consumer attention and theoretically speaking, market prices of insurance will fall further due to the increased competition between companies (HealthCare.gov).     The Patient Protection and Affordable Care Act

    The bill contains provisions that will go into effect on June 21, 2010 and September 23, 2010. Also, the additional provisions will go into effect in 2014. Title I of H.R. 3590 will ensure quality affordable health care for all Americans by eliminating discriminatory practices by health insurers such as pre-existing condition exclusions. Title I also extends dependant coverage up to age 26, caps insurance companies non-medical expenses, and prevents unfair termination of insurance policies. Title II expands eligibility for Medicaid to lower income persons and assumes federal responsibility for much of the cost of this expansion. These bills provide enhanced federal support for the Children’s Health Insurance Program, simplify Medicaid and CHIP enrollment, and improve Medicaid services. Title III will strengthen the quality of healthcare by establishing The Physician Quality Reporting Initiative (PQRI) which is a value-based purchasing program for hospitals that link Medicare payments to quality performance. Title IV puts into place a new interagency council to promote healthy policies and to establish a national prevention and health promotion strategy. Title V will encourage innovations in health care workforce training, recruitment, and retention, and will establish a new workforce commission. Title VI creates new requirements to provide information to the public on the health system and promotes a newly invigorated set of requirements to combat fraud and abuse in pubic and private programs. Title VII allows certain hospitals and treatment centers to receive discounted and/or generic drugs to aid their budget.     The United States in the past month has gone through a rollercoaster ride of events, from government shutdown to fiscal cliff deadline. All of these fall short to the main focus of this paper. The Patient Protection and Affordable Care Act (ACA) will affect every person in the United States however; I will focus on the benefits of the ACA on the rural American. The ACA was passed in 2010. ACA will require insurance to include 10 categories of essential benefits allowing for more people to get the coverage they need. ACA will limit the premium variation pending on age and existing medical conditions. Lastly, the ACA creates eight new taxes and fees paid by insurance companies that will help subsides the increase in cost for health insurance.
