Can Management Afford to Look the Other Way?

Harry Rull had been with Shellington Pharmaceuticals for 30 years. After a tour of duty in the various plants and seven years overseas, Harry was back at headquarters, looking forward to his new role as vice president of U.S. marketing.
Two weeks into his new job, Harry received some unsettling news about one of the managers that he supervises. During a casual lunch conversation, Sally Barton, the director of human resources, mentioned that Harry should expect a phone call about Roger Jacobs, manager of new product development. Jacobs had a history of being “pretty horrible” to his subordinates, she said, and one disgruntled employee asked to speak to someone in senior management. After lunch, Harry did some follow-up work. Jacobs’s performance reviews have been stellar, but his personnel file also contains a large number of notes documenting charges of Jacobs’s mistreatment of subordinates. The complaints ranged from “inappropriate and derogatory remarks” to charges of sexual harassment (which were subsequently dropped). What was more disturbing was the fact that the number and the severity of the complaints have increased with each of Jacobs’s ten years with Shellington.
When Harry questioned the company president about the issue, he was told, “Yeah, he’s had some problems, but you can’t just replace someone with an eye for new products. You’re a bottom-line guy; you understand why we let these things slide.” Not sure how to handle the situation, Harry met briefly with Jacobs and reminded him to “keep the team’s morale up.” Just after the meeting, Barton called to let him know that the problem that she’d mentioned over lunch had been worked out. However, she warned, another employee has now come forward, demanding that her complaints be addressed by senior management.

    Kimberly Ellerth worked in Burlington’s Chicago office from March 1993 through May 1994, first as a merchandising assistant and later as a sales representative. Theodore Slowik was a New York based Vice-President of sales and marketing, supervising Ellerth’s immediate supervisors. Slowik made primarily the decision as to Ellerth’s hire and subsequent promotion. Ellerth spoke with Slowik when he traveled to her Chicago office and when she traveled to business related conferences in New York and elsewhere. Ellerth was required to get Slowik’s approval of special sales to her customers. Soon after Ellerth began working for Burlington, Slowik began to subject Ellerth to harassing acts and comments, coupled with threats that her refusal to submit would result in retaliation. For example, in the summer of 1993, Slowik made a series of comments about Ellerth’s legs and breasts. Ellerth never gave Slowik’s any indication that she was interested in him. Nonetheless, he continued to subject her to unwanted touching of her body. Ellerth resigned soon after Slowik refused to authorize a special project for one of Ellerth’s customers. In this particular story a manager, Charles Jackson, is faced with many difficult decisions regarding problems concerning one of his workers at Eastern Plating. One of Jackson’s workers named Marty Reid is accused of molestation of his stepdaughter. His allegations are made public in a recent writing in the “Evening Beacon”, the daily paper of the 10,000 town’s population. Reid also has his wife going against him as well, which automatically makes him guilty to the majority of the town. When Jackson reads the paper he immediately understands what he might be faced with in the next upcoming days of work. However he has not made up his mind with what to do with Reid and his future in the company. Jackson takes the necessary steps and evaluates the situation, covering all bases, before coming to a decision or making judgments. Jackson finds himself faced with a dilemma. He could fire Marty Reid and keep many employees happy and motivated, or he could wait until the trial comes to a decision. However if Jackson waits for the trial to come to a decision, Marty could be hurt in the meantime by one of his workers.
