A Day Of Silence Case Summary
This is a case study analysis on “A Day of Silence, a Day of Truth, and a Lawsuit” by Bonnie C. Fusarelli and Lucy E. Eaton (2011). This case study explores freedom of speech and freedom of religion in public schools. Simon County High School is the only high school in the rural area dependent on agriculture. The highly conservative population is around 60,000 people, of whom 18% live in poverty. The school’s 600 students are 60% White, 30% African American, and 11% Hispanic.
This case revolves around two consecutive events at Simon County High School. The first, A Day of Silence, was held by student members of the national Gay, Lesbian and Straight Education Network (GLSEN) to bring awareness to the discrimination and harassment faced by lesbian, gay, bisexual and transgendered (LGBT) students. The second event, a Day of Truth, was held the following day. A Day of Truth was created by the Alliance Defense Fund (ADF) in response to the Day of Silence, to be able to present an opposing viewpoint to homosexuality. Unlike the previous students, Blake had not asked for permission to hold his demonstration and was causing disruptions in the hallways. As a result, Ms. Howard assigned him to in-school suspension.
The ADF, a Christian legal group, filed a federal civil rights lawsuit against the county’s board of education, the superintendent, and

The first, A Day of Silence, was held by student members of the national GLSEN to bring awareness to the discrimination and harassment faced by LGBT students. The students had gained approval from Principal Howard after she had educated herself on the group and the event. During the Day of Silence, the students did not speak during non-instructional times and passed out cards that explained the demonstration to any student that asked for one. The problem arose, when another student, Blake, decided to participate in the Day of Truth the following

As the student is giving the prayer there is no open forum as would be the case during public speeches. Without this in place, prayers before sporting events are not considered to be public speeches but are considered to be sponsored by the school. The new policy the school had to elect students to be the spokespersons to deliver the prayers was also criticized, leading the justices to believe the school was still controlling the process. The Court found the voting process that was used by the district of voting for if the prayer would be given at an event and who would give the prayer also caused rival political factions between different religion groups at the school. The voting process would create a majority win over the different religions within the district and that would be the religious voice that all would hear. The policy the district has fails to protect the rights of the minority of students. All the factors resulted in the policy of the district to be…

Perich with the help of the Equal Employment Opportunity Commission went to court to challenge the decision of the church. They based their case on the Americans with disability act, which protects Americans with disability from unfairness at work. They argued that the church had fired Perich for threatening to file a legal lawsuit. In defense of the church, their attorneys argued that the lawsuit was unlawful because it was against the first amendment. This amendment banned the government from getting involved in matters of religious organizations and employment terms with one of its ministers. Apparently, Perich was a minister because of her involvement in the religious matters of the church. There were two types of employees at the school the ‘called’ and ‘lay’ teachers. Called teachers like Perich, were misters of the church, and therefore participated in other religious duties apart from teaching.…

For my presentation, I reported on the Falwell vs. Flynt lawsuit, which was based upon the extent to which Americans have freedom of expression. An important aspect of this case was the dissimilarity of the two men involved: Jerry Falwell and Larry Flynt. Jerry Falwell was an important religious leader of the time. He was a radio evangelist, leader of a religious group called the moral majority, and voted 2nd most influential person in America (the first being the president). Falwell represented a pure America, a decent society in which its members were committed to moral standards. Larry Flynt was his complete opposite. Flynt was editor of the infamous Hustler…

Stephen and Darleen Fournier were residents of the Milford Central School District; sought to use the school after hours for meetings of the Good News Club, a private Christian organization for children. Their request was denied because the meetings were considered the same as a religious worship, which was prohibited by the school’s community use policy. The Good News Club filed a lawsuit claiming they were denied their right of free speech under the First and Fourteenth Amendments.…

Recently, some disturbing information was brought to my attention about one of Lyman Highschool's staff members. While in one of the restrooms I oveheard a convorsation about one of the theachers here at Lyman: Mrs. Neris. The other students were talking about a transgender student (who I personally do not know) and one of the mentioned that Mrs. Neris had given that student a referal for using the boy's restroom. (the student is originally female.) I was absolutely shocked, disgusted, and appalled. I felt so bad for that student. I can't imagine how embarassing and belittling that could feel. I know that a main goal of lyman higschool is to create a safe and comfortable learning environment where students can feel accepted…

The challenges that the LGBT population face are neither new nor surprising but the need to address them is certainly relevant (Thiel, 2010). In fact, it appears that for as much progress that has been made on some campuses, there has been no progress on others. The presence of violence and harassment, as well as the desire for inclusion and justice, indicates the need for attention and research as a chilly campus climate can make for a distressing experience for LGBT students, faculty, and staff.…

Issues of discrimination to transgender also occur outside of detention centers. Kit Yan shared the social injustices he experienced as a queer, transgender, and Asian American in his performance Queer Heartache. He became aware of the unacceptance of transgenders in the US when he expressed his newfound queer identity through rainbow stickers on his new Jeep Cherokee. As a result, his lights were smashes and tires were broken. Like transgender detainees, Yan was out casted and assigned to a secluded dorm on college campus. Similarly to how detainees are told to silence when assaulted and rape, Yan was recommended that for his own safety he should remove the stickers which expressed his pride and identity. The treatment of both Yan and transgender detainees illustrates the degree of unacceptance the transgender community has received in the US society.…

The cancellation of school on Friday has caught the attention of many members of Jefferson County. The schools were closed for security and safety reasons for the students. Many teachers called in sick or took a personal day but the Jefferson County Education Association (who represent teachers) said they “did not organize a protest” (Paragraph 5). Superintendent Dan McMinimee says that he thinks there are other ways to work this situtation out “without putting kids in the middle of it” (Paragraph 4). Friday morning, students gathered near both schools with signs showing their support for the teachers.…

The article is about faith-based colleges and the lawsuits filed against them interfering with freedom of religion. There is a bill that is being voted on in the state Senate in California, allowing lawsuits against faith-based colleges on discrimination. Both the colleges and students feel that they are restricted their rights. However, it affects some colleges because they receive money from the government through funding and some students have financial aid. The colleges feel that they are losing their rights to freedom of religion and that they will have to change the traditions that have been at the college. While the students that do not believe in what the colleges practice, also feel the loss of rights in how they want to express themselves.…

Today felt breath taking before I knew what would take place. While on my way to class, I decided to stop at a table and grab a piece of tape, two small cards, and a ribbon that would help keep peace for those individuals that are being bullied for being different. I don't think it's right for anyone to be discriminant against another who is gay, lesbian, bisexual, or transgender. I am not neither. However, I will do anything to support their cause.…

They were wearing black arm bands to mourn the death of Vietnam and all of them including her were suspended. They also faced harassment and many death threats. The ACLU came to her defense, winning a landmark Supreme Court decision in “Tinker v. Des Moines (19969)”.…

At that time or even today, gays and lesbians have been treated with contempt and violence by their fellow citizens. There are still many different misconceptions about gays. Many people think that gays are pedophiles, or that gays recruit others to become gay. Everyday I can realize discriminatory behaviors against gays and lesbians in my school. My best friend is gay. When word spread among other students that he was gay, they subjected him to constant harassment and called him by ridiculous name. At first, I was shocked when he told me his sexual orientation. I thought he was kidding and tried to persuade him that he were mistaken. But when I know more about LGBT community, especially when I saw “Milk” – a film about Harvey Milk’s life, about his struggle for LGBT community’s human rights and his romantic relationship, I changed my attitude. Honestly, I really admire Milk and his accomplishments.…
